Blatantly lying to get a refund, and I have no choice :-(

A buyer has bought a DVD from me on Wednesday night and has received it this morning, and I have just received this message -
"hello m8 got box 2day but no disk please could u send asap"
Why would I send a box, with the disc separately
I know the disc was there before it was packaged, because I insert 2 business cards in the inlay card of every DVD I sell - I think I would have noticed if the disc was missing when I did this!!
There is no point asking for the item back, he'll only keep the disc and send the box back, and as he has opened the packaging there is no proof to suggest it was opened in transit, but why would a lightfingered postie open a well sealed mailbag, unwrap the bubblewrap & tape, remove the disc, put it all back together, and post it as normal? They'd nick the whole damn thing surely!?
So I have no choice but to refund... although I have turned off my Automated feedback, just incase I receive a pos. The buyer has been a bit trigger happy with their negs and neutrals in the past, often over petty reasons, but it also looks like this is not the first time they have pulled this stunt. I'm ready to neg in return!
Besides, messaging me using chavvy text speak is truly unforgiveable.

Why do you have to give him a refund.. Let him make a PayPal claim and show them the proof of delivery, advise them to check his feedback which suggests he has done this in the past too, and then get them to see your reputable feedback.0

Just report him, its likely that he has been reported before as there are quite a few idiots like him. If he was cleaver enough he would have just have said that he didnt recieve the package. If worst comes to the worst just get a claims form from the post office ande claim for the lost disc, or rather tell the guy your going to do this and need his details. That should shut him up.0

It was only 2.99 and an unconfirmed address, so all I have is proof of postage, not delivery.
I have emailed saying that it was probably a theiving scrote from the Royal Mail, so I will be making a claim, and they will contact him independently to confirm the details.
Having now seen the email address, the guy is a chav of monumental proportions. A long winded addy that shows he is in to customising his Mk4 fiesta. !!!!!!.<--- Nothing to see here - move along --->0 -
if he has done this in the past then it might be worth calling his bluff as he has a limit on how many paypal claims he can make.
I think I might be tempted to respond and say that you know the disc was there when sent and unfortunately you feel unable to offer a refund. Yes he can go to paypal and tie up your accounts, but he might just decide not to persue it at all. if he does persue it and you lose the claim you are not really any more worse off than if you had just refunded.

No proof of delivery - I never do for low value items I just take the risk. Besides, when do Paypal ever listen to reason!!

yeah, proof of postage is enough to make a claim with RM, but Paypal need Proof of Delivery - Recorded or Special delivery.
To be fair, it's a risk that I am happy to take, it's just that when somebody blatantly abuses the trust that I get annoyed, but I know I can't win any dispute so I'll wait to see if the email has called his bluff.<--- Nothing to see here - move along --->0 -
I have made 2 claims in the past week as people that I have posted to have said they havnt recieved their DVD. I always say first that I will have to report the item as lost and give Royal Mail their details. And you would be surprised of how many people never want to reply and give me their details, although I already have them on the invoice I was sent. Just shows how many people try it on.0

It is immaterial whether proof of delivery was obtained or not as buyer is saying it has been delivered but a disc is missing, so the OP would be no better off having spent an additional 70p to get a signature. A claim for item not as described is different to a claim for not received...and I would think the buyer might have a problem if he confirms delivery to paypal and adds that a part was missing and then makes a full claim for not received.
