Parking Eye - Appeal Process

That's lovely, hope for the same! I have found the minutes thank you and highlighting the relevant sections, will continue to work to build a solid defence I hope.0

So on Saturday I received a copy of PE's defence. They refer to ParkingEye v Beavis and provide a shortened version and a link to the full Judgement. When they get to our actual claim they state 'ParkingEye can confirm that we operate a grace period on sites which give motorists time to enter a car park, park, and establish whether or not they wish to be bound by the terms and conditions of parking. The grace periods are in line with that stipulated by the British Parking Association'.
In the BPA minutes from July 2015 section 7. Reference from panels it says 'Implications of the 10 minute grace period were discussed and the Board agreed with suggestion by AH that the clause should comply with DfT guidelines in the English book of by-laws to encourage a single standard. Board agreed that as the guidelines state that grace periods need to exceed 10 minutes clause 13.4 should be amended to reflect a mandatory 11 minute grace period.
That's good and in my favour?0 -

I haven't read back over the thread, but if you're within the grace period timelines, then yes. Build that BPA statement into your court papers. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hi, I was 10 minutes 48 seconds, I had left my purse at home so unable to pay or go shopping, in this time I was frantically searching for my phone and text my husband who confirmed it was at home.0

Apologies, it is a 'reply to defence', I assume in response to my skeleton defence0

Hi I have received a parking ticket from parking eye in which I appealed using a template I found on here.
The appeal has been unsuccessful which I knew it would (I was lead to believe it is at this stage the appeal will win).
What do I do from here in regards to getting them to send a poplar appeal code? Any help would be greatly appreciated!0 -

You have just jumped in on someone else's personal thread, contrary to forum rules.
Please read the NEWBIES FAQ sticky, post #3 for information on appealing to POPLA. Any more advice needed, please start a new thread of your own. Please note, we are not a legal advice forum. Hi, I was 10 minutes 48 seconds, I had left my purse at home so unable to pay or go shopping, in this time I was frantically searching for my phone and text my husband who confirmed it was at home. Thanks for all the advice, yesterday was the cut off for them paying the court and today I received a very curt letter ‘we write to confirm that ParkingEye now consider this matter closed. We have notified the court that we do not wish to proceed with the above numbered claim’
thank you all for your help and advice.
Yay, and they should be ashamed of the wasted time in pursuing this one over 10 minutes which is allowed within the set/required Grace periods.
Now, perhaps you might consider writing to your MP to tell them about this intimidation. This is a copy of a post by Bargepole:
"Some action at last:
http://services.parliament.uk/bills/2017-19/parkingcodeofpractice.html
This Private Member's Bill has Government and cross-party support, and stands a good chance of making it into statute.
The full text of the clauses will be published nearer the date of the second reading, but my sources tell me it's something we should support.
Now would be a good time to write to your MP urging them to support it."
:T
So glad your case is over, won by you! Well done for keeping the faith.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
