  • How has the mortgage been paid since Nov2015?

I paid the mortgage up until the house went on the market.

The mortgage has not been resolved.
Then I don't see how probate can have been granted, because your mother's estate is not fully settled.

Sure, but if you can afford to take a mortgage on for this house, you can afford the same size mortgage on another house.

    you missed my whole point.
I don't want another house for reasons explained..I want this one. If I can afford it and give them what they need then why cant I have it?

Maybe because their opposing view is equally valid?

Rather than being confrontational try the softly softly approach....

It was just a suggestion :D If you are set on it then go down the route I suggested, eg making it easy to sell to you and difficult to sell to anyone else.

The softly softly approach hasnt worked..I was cooperative and submissive (apart from having to involve the police for in the violence for my own safety) up until this past week when it came to light that I could buy the house and they ALL began with the spiteful attacks.
The brothers had made it very clear that all they want is the money and they want it ASAP until I said I could buy the house. I have acted on their wishes and of wanting money. Now its spiteful that they just don't want to sell to me. I don't see this as valid.

You think it's spiteful and invalid. But look at it from the other side...

It's now ten months since your mother died, and eight months since probate was granted. A buyer is lined up for the house. One brother has a small baby. The other brother is very likely to have financial problems, perhaps even substantial debts.

Now there's looking like a further delay while you sort out whether or not you can raise a mortgage.

If the shoe was on the other foot, wouldn't you be pushing for a resolution?

there is no delay...my money will actually be processed before the sale completes theyr not even as far solicitors yet. The only reason the money isnt sat in the bank today is because I havent paid the final fee to have the money deposited because its alot and the execs have already said theyre not going to go with my offer. My offer which matches the current offer can be complete in as little as a week...
