The OP should read the Computer misuse act. It's not very good legislation (hurriedly introduced, badly worded) but would seem to be applicable here.

Surely you're not suggesting your husband is unfaithful and using this as an excuse to put a snooper on his phone simply because one of his customers gives him a Christmas card and a tip every year? I give my newspaper deliverer (a mature male in his 60s) a card and tip every year but that does mean I'm a relationship with him. Some people just like to say thank you to people and show their appreciation.
From my experience of bin roundsmen, they work like maniacs to cover their schedule and often don't even to seem to have time to put the bins back properly let alone have time for any misdemeanours on their routes.
Has he given you any other specific reason to mistrust him? If so ask him openly. Otherwise some could judge you of exactly the same kind of deceit you seem to be worrying about that he is committing.

I sometimes leave a card with a fiver in for our binman. But I can assure you if I was having illicit relations with him I certainly wouldn't be giving him money. I'd feel like he was already getting enough from me.

We've got the filthiest binman you've ever clapped eyes on, he eats sandwiches as he pulls the bins out and hold the sandwich in his mouth as he hooks the bins to the back of the wagon, and I kid you not!i feel sick when I see him, his fluorescent top is just black! I'm was actually thinking of leaving a box of soap powder on the bin this Christmas!0
