Signing over council home to someone who already owns a council home

    Council / housing association is used interchangeably. You're STILL missing the point which is shocking. If his goal was to buy it and "add it to his portfolio" then would just give her the money. I am certain anyone is entitled to buy their home regardless of where the money comes from, as long as the money is legal, which is it.

    Why not just cut out the middle man and give her the money to buy the home? I'll tell you why, because he doesn't have the money to buy it, it's not about buying it. The house is valued at over £250k he certainly don't have that money.

  • Surely, wether or not the brothers house is ex-council or private, he owns a property. Therefore he is ineligible to rent social housing.

    Note the reference to "main home" in the second link. I don't think that could apply in your brothers case.

    Have you looked at your mothers tenancy agreement.
    It may state something like ""Your council tenancy must be your only or main home, If you have or acquire another home, you may stop being a secure tenant and we can ask the court for a possession order so we can evict you"

    The same condition is likely to apply to your brother if he applies for joint tenancy even after staying with your mother for the required period of time.

    Have you looked on your council's website?

    This is what we're trying to find out because it doesn't actually mention it anywhere in the factsheet. Will just wait for them to reply.

    As far as I'm aware succession is only possible if your brother can prove he's lived there for some time so would need a trail of council tax , electoral roll entries etc otherwise it's a no

    You have the answer - no - he can't just be put onto a tenancy unless the council/HA let him so WHAT do you want to know

    He/your mum will have to fill in the forms then they will be told officially or wait for the HA/council to respond to your letter

    If he does succeed in the getting on the tenancy then he has either lied or the council/HA are stupid

    It does mention that person needs to be living with you for a year, which is fine because he can just move in there for a year to be eligible. Again there is no mention here whether or not the person you sign it over to is not eligible if they already own a council property.

    I'll just wait for the reply back from the council. I'm sure I won't receive an ill-hearted response.

    He's going to move out of his own home and live with your mother for a year, just so he can get his name on the property? A property he doesn't need because he already has one. The same property you've had valued.

    I'm feeling sorry for mum here, the last thing the kids are thinking of here is her. She has nothing to gain from giving away her tenancy.
