Am I the only one to notice that the vast majority of threads currently relate to LBCs and court claims, rather than about PCNs?

What do people feel are the reasons for this sea change in activity? How can we address these issues?

Obviously there aren't that many of us that able (or even willing) to help out here - so what's the way forward? (Obviously we are ALL glad to see C-m back).

    I think we probably need to spend a lot of time working on the MSE guide and providing links to appropriate stickies that walk users through all of this. Assuming the MSE team will work with us to fix it.

    I am not convinced, not now.

    I believe that was the 'good' intention - things like capping the sum at £50 - but Brexit has tied the Government up and you can be sure that the suits at the BPA will have lobbied hard, since the public consultation, and will be the loudest and most recent voice the DCLG will remember.

    I am concerned that we need to do more than fight fires and have been discussing with with some other posters. Court claims have become far too common, you are right.

    It is certainly a change that shedloads of claims are being walloped in and it is a scandal waiting to be discovered, just how many poor people will later find a parking scumbag has got a CCJ against them. And the Scumbag will merely have sent a couple of letters to an old address and spent £25 fees to prey on people who then have to pay £255 and suffer court hearings just for the chance to turn it around.

    The system is broken and unfair on consumers; this was not the intention of the small claims track.

    One of the issues is how the principal seems to duck ad dive and avoid being tared by the PPC brush.
    Those who allow PPCs to act in their name should be the ones facing negative publicity, and if possible the principal should be the one who is stung in court when the court rules in favour of the motorist.

    PPCs are like wild dangerous dogs/animals and if a wild/dangerous animal attacks/injures a member of the public, on land where the public have access the its the farmer responsible for allowing the beasts onto that land could find himself/herself in trouble.
    From the Plain Language Commission:

    "The BPA has surely become one of the most socially dangerous organisations in the UK"

    Almost gone are the days of 'Review my draft POPLA appeal', it's now 'Review my draft defence'.

    I'm no lawyer (armchair or otherwise), so I tend to signpost posters (with links) to read through threads on Leagle Beagles, CAG and PePiPoo, and to register and post there if they feel it necessary.

    Another point to make is the 'throwaway' 'Do a search for a Gan letter'. The reality of this is with a forum search, generating results on a 'latest first' basis, the searcher is face with a wall of posts showing ........ 'Do a search for a Gan letter', and find themselves going around in a circle of frustration.

    A sticky on PePiPoo to cover the various stages of dealing with BWL/Gladstones letter trails, with appropriate 'Gan letters' linked or posted in the sticky, might just save everyone a good bit of time and frustration, making it easier for posters and more difficult for their pursuers.

    Let us hope that a few of the pre POFA "Elliot v Loake" cases are thrown out by judges.


    I have a couple of old PCNs from that era which I ignored, I would love to get taken to court on those.
    You never know how far you can go until you go too far.

    This is my conjecture here, but I'd say that the Tory govt allows it because the PPCs are political donors to their party coffers. And I'd say that Labour are just as bad.

    And that maybe the case but this particular Tory party need to show themselves as squeeky clean in terms of donors .... if the press got on this Theresa would be out as quick as she got in.
    As far as Corbin is concerned, complete piffle of an outfit, I mean he is so blind he could not see a seat on a train ??? what does that tell you ??

    As far as Brexit is concerned Theresa has appointed those to deal with it.
    That did not apply to the DCLG who should wake up
    NO EXCUSES FROM GOVERNMENT, the motorist makes up a mega part of the voting public .... ignore it at peril.
    The British pubic will NOT BE SCAMMED

    Beavis. If the strong arm tactics can bring in significant revenue on it's own they'll see that as a win win as then word gets around and more people will just pay up the newer tickets. Additionally the Older tickets have charges added so the paid %age required to make it very profitable compared to fresher tickets is much lower. They are getting in before the statute of limitations kicks in for many tickets.

    In the short term you cannot do much aside from setting up cases to be won or conceded, longer term the fruits of the defences may help.
