ES Parking Enforcement/ Gladstones Claim Form

I'm hoping to get some advice.

I pulled up in Spinningfields, Manchester to pick up a friend in May. Yes I was on double yellows and sat in the car for a couple of minutes. A week or so later I received a parking charge notice from ES Parking Énforcement, from advice on friends/ colleagues I ignored the charge and the subsequent final reminder letter.

Today I've then received a County Court Claim Form from Northampton via Gladstones Solicitors. I'm not 100% sure whether to ignore this as well as doing some research online I'm not sure whether it's genuine or not. The 'stamp' and 'Royal crest' are both fuzzy and printed on, the paper in white/grey as opposed to the White/blue on the government website.

Any advise would be welcome, I'm planning on ringing the county court in Northampton on Tuesday to confirm whether they have sent the form to me. I've read a few posts but in all honesty I got a little confused and realised each case is slightly different.

    First of all the advice to ignore is 4 years out of date since the law changed in 2012.

    You are doing the right thing by querying with the court whether this is genuine or not.

    If it is you need to read the Bargepole step by step guide to court, linked from the Sticky thread for NEWBIES. You can also buy a very cheap guide to court from the Parking-Prankster's blog-site. I am told it is most excellent.

    If the claim is not genuine then you need to complain to Trading Standards, contact the local and national press, and your MP.

    If you post up a redacted copy of the claim form the experts here will look at it for you.

    Thanks Fruitcake, I realise I shouldn't have ignored the charge but I can't change that now.

    I'll try to upload a copy of the form to hopefully get some help. 😄

    You will need to upload it to a web hosting site such as tinypic or photobucket, then paste the URL here, but change http to hxxp as newbies can't post live links.

    No need to upload the form - unless you can ensure that you have completely edited your personal information from it, including possibly the total amount claimed as the parking companies do trawl the forum.


    It will be a genuine claim form and there is a surge of ES Parking Enforcement / Gladstones claims at this location.

    Firstly you should acknowledge service of the claim as this will buy you more time to prepare a defence to 28 days from service.

    NB THE CLAIM IS DEEMED SERVED 5 DAYS AFTER THE ISSUE DATE STAMPED

    This needs to be done within 14 days of service of the claim and you will need to create an account on MCOL government gateway for this.
    Take a note of the email and password you use for this account to log back in again.

    To acknowledge the claim
    Tick the box you 'intend to defend the claim in full'
    Leave the defence box blank

    Do not select the box to contest jurisdiction - unless you do not live in England or Wales.

    You will need to complete some personal details before submitting.

    I think the MCOL website is closed today for maintenance so you should be able to do this tomorrow or Monday.

    This will be a real claim, as it came from Northampton. DO NOT IGNORE IT.

    Read all the other Gladstones defence/claim threads on pepipoo forum (search for 'Gladstones'):

    Loads of those threads show a decent court claim defence. You can crib from them.

    Also read the Parking Prankster's Blogs about the recent cases lost where Gladstones have filed claims with almost no details nor due diligence, it seems:

    Plenty more on the right there in the list of recent Blogs, look at Gladstones ones specifically, read them and take comfort from the fact they really do lose, a lot of the time!

    You cannot ignore this nor miss any deadlines if you have court papers. The keeper can defend this though.

    This is not all over, nor time to pay up (even if you lost at a hearing you would likely have to pay LESS than Gladstones are demanding...no CCJ, nothing adverse as long as you then paid if you were unlucky and lost in the end). Many Gladstones cases are won by Defendants who go into details about how rubbish the signs were, so get some photos if you are local. You will need them in your evidence and please show us those signs, this weekend if you can.

    Firstly acknowledge the claim and start reading other Gladstones claim threads, drafting the defence which you have to follow the acknowledgement with. Reading other threads on pepipoo and here will show you what's needed.

    Do not reply to any 'private message' you might get on either forum, if you register on pepipoo as well. People sending messages offering to help are not to be responded to, could be the parking firm, you never know. Keep it in the open, stick to this thread (and any thread you start on pepipoo) and you will get lots of assistance with the defence wording.

    If it is a claim, and it likely is, go onto Google Street View and look around for any parking signs in the vicinity. Look for two types - normal road signs and then ES Parking ones. You'll see a difference in the way the "rules" are communicated. Parking ones are two small.

    Also if you can get a copy of the ESP signs close to where the event happened you'll see they are "forbidding".

    My thoughts are that it id NOT genuine. If it was, how come the OP received it via Gladstones?


    If Gladstones are sending out fake court papers this surely is a matter for the Police and the SRA.
    You never know how far you can go until you go too far.
  • Thanks everyone. I'm going to call the court on Tuesday to make sure it is genuine. However from reading some of the other threads I never received a notice to keeper or letter before claim, does this mean they have missed out vital letters in order for their claim to stand?

    They also appear to be charging me for two separate occasions but again I don't recall receiving two notices just the one followed by a reminder.

    I'm away at the moment but will get some pics ASAP
