Looks like a so called forbidding contract/rule to me
    From the Plain Language Commission:

"The BPA has surely become one of the most socially dangerous organisations in the UK"

Thanks everyone. I'm going to call the court on Tuesday to make sure it is genuine. However from reading some of the other threads I never received a notice to keeper or letter before claim, does this mean they have missed out vital letters in order for their claim to stand?

They also appear to be charging me for two separate occasions but again I don't recall receiving two notices just the one followed by a reminder.

I'm away at the moment but will get some pics ASAP

If the form has a claim reference number and password on the front page then it is a genuine court claim.

What makes you think yours is not genuine?

There are many claims issued via Gladstones and various parking companies including this PPC and at this location.
  • Hi Sara

I too have received a court order is gladstones in the last couple of days for parking in the Spinningfields area where there were no double yellows and no signs
I fully intend to contest it and have ignored all correspondence until now
I need to start to draft my defence based on the really useful info people have posted on here

  • Thanks for the picture I actually managed to get one last night as well. Also noticed that there isn't many around.

I thought the claim might be fake purely because of the quality of paper and the blurriness of the Royal Crest and Stamp.

Do I need to send the paper copies off or can I just do everything online?

At this stage it is online - Acknowledgement of Service, then defence (after checking with us and showing us your draft first).

After that you do get paperwork you have to complete and return and copy to the claimant - but that's explained already by bargepole in his post I have linked in the NEWBIES thread under 'Small Claim?'. Bargepole explains what happens when and how to complete the forms.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

  • Right so I have just sent my acknowledgement via the moneyclaim website. I've done this as 'Intend to defend all of this claim'

I realise I now have 28 days to provide my defence. Where is the best place to start?

Where is the best place to start?

Drop a line to change@capitalproperties.com to say you have a court claim from ES Parking and you'd like to know the name of the person responsible for the Spinningfields Management Company account. Specifically if they have the authority to issue claims in their own name without resort to SMC. Bernie Howarth may be the contact.

Put in your defence that you believe ESP does not have the authority to take action in their own name as the principal has failed to confirm the same.

Any vague reply or no reply will cast doubt on ESP's legal standing.

  • Thanks I've just sent an email across now
