Questions about Evans halshaw warranty

Hi There

I am recently buying a used ford focus from Evans Halshaw. The sales person told me the car would be with 3 month EH warranty. But when he threw me the 'used vehicle order form' and asked me to sign it, I could not find where the warranty was stated in the form and its terms and conditions.

I get confused here as I think the contract should at least have stated that the 3-month warranty is provided and included in the price. I know the EH warranty is useless actually but I feel it's better than having nothing.... I would appreciate any suggestions from you guys with experiences buying used car from EH to explain where I am standing now... Shall I ask them to add the warranty in the terms /conditions before I sign the contract?

Cheers

write on the contract when you sign it that you sign to also confirm full 3m warranty.

Maybe, but there are far more alternatives to eh, and I'd put a few quid on the complaint rate being even higher for eh than for Royal Mail.

Unfortunately I have only read these terrible complaints on EH after I signed the 'used vehicle order form' and paid 250 quids as deposite with my debit card.

Generally I like the car and feel it's a good deal for me. If the used vehicle order form does not state any warranty issue, does that mean I will have to buy that car without any warranty from EH?

PS, I HPI'd the car yesterday and it showed the car is with some outstanding finance called 'Unit Stocking' by another company LOMBARD BUSINESS FINANCE. I googled it and found such 'Unit Stocking' is quite common for car dealers and will be cleared when I pay for the car in full. But since EH does have a very low reputation, shall I worry that I will be screwed by EH about the outstanding finance after I pay the rest in cash?

    Hi Loskie

Thank you very much for your assurance. Do you think I shall worry that the warranty is not stated in the contract?

    Cheers

Things need to be recorded in writing or there is a good chance that there will be no record.

You should have a written conformation of warranty and also what that includes or excludes. Many things won't be covered because they will be assumed to be wear and tear on any second hand vehicle, depending on the age, mileage and condition of the vehicle when it was sold.

Have you bought this vehicle or have you just placed a deposit?

    Hi bigadaj

Thank you so much for the suggestion. I also feel everything they promised should be recorded in writing, agreed and signed by both parties.

I placed a deposit and signed a so-called 'used vehicle order form' to collect the car after a couple of days. I feel such form is more like a prerequisite of purchase agreement in that both parties could cancel the contract at this point. Of coz the penalty of me cancelling is to lose the deposit. So I think technically we are still not legally binded to complete the transaction... But since I have never bought a used car, I would be really grateful for any suggestions of my thinking, as I can probably still afford losing deposit if I pull off at this stage...

No you don't need to worry because they can't. As a bona-fide trader (I know, I know) any outstanding finance is their problem. Even if there was an outstanding HP agreement to Fred Bloggs of Blogshire you would have clean title.
