only getting DLA - no other benefits

My OH is disabled and he currently gets DLA at the highest rate (letter rcvd this yr confirming he will receive it indefinitely) but because I work full time .......he is not entitled to anything else. He was turned down for ESA earlier this yr and cannot get JSA as he cannot actively look for work as he is disabled. Am I missing something? are we entitled to anything else? I keep hearing about PIP but have not done anything about it as he is still on DLA.


Any advice you can give would be appreciated.

  • Depending on your earnings, you might qualify for Housing Benefit (if renting) and/or council tax support. If your husband uses a wheelchair iindoors, or has a kitchen, bathroom or therapy room for his sole use, you could apply for a disability related reduction on council tax.

    he was rejected by atos in 2012. We appealed it. Was rejected again. Told earlier this yr we can start new app so we did... Then got letter to say original rejection from 2012 stands. unless he has a new disability he cannot apply. He has osteoarthritis in both ankles & cannot walk. Heavy medication so not always compusmentus to go and do a sitting down job....

    We are on interest only mortgage but we are selling up cos cannot afford it on my wages alone plus I'm pregnant now so need to move out before I start mat pay otherwise will b on the street in Jan when baby arrives.

    Is the DLA high rate care or mobility or both?

    To be honest, there is nothing he can apply for in his own right as he would not be eligible for contribution based benefits having not paid NI contributions in the last two tax years.

    He would not be entitled to income based benefits as you are working and your wages/maternity pay would be more than the income based benefit making him ineligible.

    So, anything else you are entitled to would be based on a joint claim - possibly working tax credits, and council tax reduction.

    You could try putting your details into the calculator on https://www.entitledto.co.uk while you are working and then again when on maternity leave.

    Of course, things will then change after the baby is born depending on whether you return to work or not.

    Of course you could go to CAB and ask them to do a benefit check for you both.

    Why are you taking extended maternity leave when your partner is home to look after his son/daughter?

    is it really necessary to make comments like this?

    The OP says her OH is on heavy medication for his arthritis which suggests that he would not be fit enough to care for a baby/young child.

    Of course, its the situation we were in with both of our children, so my wife had six weeks off with the first and four weeks with the second and I looked after them on my own after that.

    Op I speak from experience after being diagnosed with OA in my ankles, hips, knees neck and spine in my late teens, been on some heavy medication through the years and managed to work full-time for 28 years.....Never once saw myself as disabled or claimed any benefits for it...I'm presuming he's fairly young still so giving up employment for OA on the ankles is plain madness.... If the medication is too much for him then he needs to speak to the Pain Clinic who will help by finding him a medication that will help in on his way.
