    I'm sure his dad won't expect him to be a guarantor for his care home fees.

    May hinge on whether the landlord had authorised the letting agent to act for him in this way. What would happen if the landlord had only contracted the letting agent as a tenant finder and was managing the property himself? On what authority would the tenant have paid rent to the agency, other than a private arrangement?

  • Those arrangements whereby the agents holds the money and hands it monthly to the landlord are usually nonsensical, with the agent and landlord not knowing what they are doing (or the agent pulling a fast one on the landlord).

    When the rent is due and paid to the agent it belongs to the landlord. The tenant cannot get it back unless the landlord agrees or a court orders the landlord to pay it back.

    Clearly it isn't in the landlord's interest for the agent to hold the money so the agent is also breaching his duties to the landlord.

    That's a matter for Agent and Landlord to resolve.


    The tenant has paid rent to the Landlord, via the agent.


    It's in the Landlords interests to get that money fully, ASAP
