One further thing to consider is when this tenancy ends. In my kids' uni town contracts finished on 30 June. You don't want this contract to finish months after everyone elses or he could have problems next year.
I would think the length of the agreement could be changed quite easily.0 -

This is why you need to read the contract before considering your options otherwise your son could end up paying rent on 2 properties.
I probably should get hold of a copy of this contract. Do landlords seriously expect tenants to find new people should one move out? They truly do not want to lift a finger do they? It's not surprising this business has got such a bad name given the arrogant and high handed way these landlords behave.0 -

Exiled is correct - once a tenancy has started. A tenancy cannot begin without taking legal possesion. But your absolutely right, the selfish landlord giving the tenant a chance to move out early. I'd remove such clauses and keep the tenant ( who maybe dropped out of uni etc ) liable for the full amount of debt. With 6 years to chase the debt it shouldn't be too difficult, and throw a CCJ in to the equation.0 -
There is no sign of this happening. There were a few threats of it last week but they seem to have gone away. The thing I find astonishing is that they have all signed up for unlimited liability without a murmur. It makes you realise why the financial services industry keeps coming up with new scams, there seems to be a bottomless pit of mugs to con.
I understand your unease as I have had to do this for both of my children. From what you say here, all the other parents have signed so this limits your exposure.
If I were you, then I would just sign as if I were in the shoes of the other students' parents, I would be strongly dissuading my child from sharing with your child due to the hassle of you not signing. So, it might have negative results down the line.0 -

In student rentals it is common to say you are liable for rent until the end of the contract and if you move out you either continue paying or find someone to replace you for the remaining period. I suspect that the only way you could (effectively) shorten the contract would be to find people to replace your son and his friends
As Guest101 says the tenancy may only start when the keys are collected , however as it is a joint tenancy that could apply to when any tennant collects the keys so could be started by one of your son's friend's collecting the keys.0 -

Do you undestand the concept of a legal contract?
My son picked up 8 sets of keys for his student house, any one of them can collect the keys with ID.0 -
I did read it, it demands that I I “indemnify the Landlord in full and on demand against any losses, claims, liabilities, damages, demands and expenses.” Ie I cough up for anything they want and on demand as well, no room for argument or discussion. That looks pretty unlimited to me. They did say that "you would never have to pay unlimited damages" but when I said fair enough, put the limit in the contract then, they refused which shows they were lying in the first place.
No, it doesn't say that. If it says that you would be responsible for paying the landlord if he goes on holiday and loses his wallet in Spain. He could even start sending you bills for his petrol travelling to and from work. I have no doubt at all that it says something like "arising from the tenancy agreement."
If you want to be a barrack room lawyer you have to get a lot better at it.0 -
