parking eye in letter state the internal process has been exhausted and provided popla code, now the letter has come in my name rather than the registered keeper, take it i have less protection than the registered keeper, ???

So you are not the RK as well then, looks as if reading between the lines you appealed as driver when this first arrived and now received rejection letter and PE have re-issued the charge in your own details as driver.

Was the rejection letter with POPLA code in your name or the RK's?

    Hi Umkomass

PE know that I was the driver as I stupidly appealed using my parking permit number for the hospital trust as I was parked on hospital ground and got a charge in post several weeks later.

I have trawled through the newbie feeds can locate #3 and what I have read all refers to not identifying yourself tp PE.

I appeal by PE was refused and I got a POPLA code with the letter. the letter is a week from the day it was processed. so 10 days of appeal to POPLA already cunningly gone.

Help needed to do POPLA Appeal to suit my situation.

    thanking you in advance

    Hi Parkingwoes

that's correct I am not the RK and the refused appeal letter and a PCN notice have come in same envelope in my name as I was stupid to appeal in my name and not the RK as I was told by trust I should put my name, permit number and car reg when I appeal to PE.

    thanking you in advance

So, presumably there might not have been enough patient parking spaces.

you can use this hospital one for inspiration but will have to change the PPC from Gemini to Parking Eye and as you have given them the drivers details you cannot hide behind POFA2012 so will have to remove some parts and maybe alter it accordingly , plus maybe see if anything else can be added

    https://forums.moneysavingexpert.com/discussion/5490211

    the main points will be

    no landowner contract
    poor signage
    BPA CoP failures
not the same as the beavis case

    and anything else

in future , NEVER give away drivers details , the trust are fools for telling you to do so and infringed your legal rights by doing so

Post #3 is all about 2nd stage POPLA appeals. It's headed:
SECOND STAGE APPEAL - POPLA OR IAS

You really have to put some work into this and have something drafted. We have lost our most prolific and knowledgable poster (Coupon-mad) and this has taken a great resource away from you (and others) and the forum.

But I expect Bob Jameson will be along shortly to help you draft your response.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

line manager advise to contact carparking on site, as that is the process and as I forgot to do that I have got this PCN charge. so not sure what else I can do on that front.

Union going to get back to me next week, but there take there is a process by which to avoid the PCN by contacting on site carparking, hence I have to gather information before they can help/support me.

for parking on site for patient and visitors the ticket is £2.20 the PC amount charged is £70.00, which means in order to accrue that charge I needed to have parked on site for just under 32 hours.

    is it all lost??????????????

I can't help but think that Mr. Jameson now thinks that his work here is done, and that we will be hearing a lot less from him in the future.

However, I'd be quite happy to discover that he is more scammed against than scamming, and that he can be relied upon to use his extensive knowledge to help those issued with private parking charges...

PS: I almost managed to type that with a straight face.

You've already been told what to do in posts #16 and #17 above. Construct your POPLA appeal on the grounds advised and then post it on here for the regulars to review.

Do not miss any deadlines - it is very likely that if you do then Parking Eye will issue a court claim against you.

    Hi Prowla

Parking was never an issue at the trust. getting PE is a money spinner for trust, patient parking spaces were never an issue. staff have always been limited, but id you let carparking at trust know they then unofficially authorise your park in patient space and that what I forgot to do this, was a particular stressful week
