As the event happened in Wales you are entitled to a POPLA appeal, my advice however would be to ignore it and all the subsequent letters you will receive completely. It is imperative that you do not identify the driver, a POPLA appeal would be a waste of time. As you live in N. Ireland, you are 110% safe to ignore.

And if you want to know what has ever happened the 10's of 1,000's of people in NI who have ignored Private Parking Companies.the answer is absolutely nothing!

Read some of my previous posts for information, I live in NI. PM me if you need more assurance.

If you're in NI, you're out of jurisdiction. Are PE pursuing you under PoFA 2012 saying that the registered keeper is liable? Check the letter you've received. Maybe upload it here, fully redacted, for our opinion. Use free hosting site like Dropbox, Photobucket, or Tinypic and change the URL link to read hxxp instead of http.

    Here is the letter,

Thank you. We have never had a parking ticket before so we don't have a clue how to deal with these things although we have learnt our lesson to never park in an Aldi car park again unless we have entered our vehicle registration in some terminal whatever they look like.

Did PE address that letter to the RK in NI? Does the car have a NI reg number? If so, you are in a very good position to play games with them Ask them lots of silly questions, offer them a fiver, when they refuse offer ten.

Play letter tennis, cost them money.
You never know how far you can go until you go too far.

Yes, PE addressed the letter to the RK in NI. Yes, the car does have a NI reg number.

It is very confusing what is the correct way to proceed with this because although we reside in Northern Ireland we got the "Parking Charge Notice" as a result of parking in Wales.

Ignore it. There is no keeper liability in NI. It is not confusing.

PE want you to pay up or get scared & tell them who was driving. Do neither.

If you search this board for 'Northern Ireland' you would find threads like yours, all ignoring the scam. No help needed, this is simple.

I believe that, because the parking event took place in Wales, then the POFA (technically) does apply to that land and also, POPLA should be available. But any court claim would fall down because it could only be pursued in NI court, where the POFA doesn't apply/is not recognised. So the wording quoted by pappa golf is misleading, certainly.

Perhaps some fun can be had even though the OP can safely ignore this or reply online (on the contact us/appeal page - ONLY choosing 'registered keeper' on the drop down menu, of course!) telling PE that the driver WILL NOT be named and warning them to cease and desist in sending letters misleading a keeper living in NI, about the possibility of 'recovering' a charge under the POFA in a NI court. That cannot and would not happen because the POFA does not apply to keepers in NI.

The OP can also complain by email to the BPA and the DVLA about ParkingEye sending out a misleading Notice saying that 'we have the right to recover' the charge from a keeper under the POFA in this case. They don't, they can't and should have used a non-POFA NTK.

Might be better to 'appeal' and complain by email to the BPA/DVLA than the OP panicking about the crappy debt collector letters over the coming months.

DO NOT write about the driver or you will undo the entire protection you have in NI, which is why we firstly suggest you can ignore it.
