UKPC do win some court cases. They normally choose mainly people with multiple PCNs who 'owe' hundreds or a 4 figure sum, as the stakes are higher and the court fee a minimal outlay.

But you are addressing this with a complaint to the NHS Trust/PALS and you know the submit an online appeal on days 26, on UKPC's webpage, from the keeper. So you are nowhere near being sued for this 'charge' and have every chance of getting it cancelled by complaint or maybe, by POPLA in the end (but they are hit and miss with their decisions).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Just an update .
Eventually got an email reply from pals and as expected they said they couldn't do anything. Emailed them again, this time stating some the facts mentioned in the posts above. They replied that they still can't do anything but will forward my email to the Estates and Facilities manager. He replied saying the contact with UKPC wasn't with the Cumberland Infirmary.
The Cumberland Infirmary car parks are run by our service provider Interserve on behalf of the land lord Health Management Carlisle Limited
Any thoughts on this quote. Surely ultimately the trust is responsible .
Anyway have started the appeal procedure now as 28 days has passed.

It should be interesting to see what it says on the contract. Is this sort of thing contrary to government guidelines,

    https://www.gov.uk/government/publications/nhs-patient-visitor-and-staff-car-parking-principles/nhs-patient-visitor-and-staff-car-parking-principles

NHS organisations should act against rogue contractors in line with the relevant codes of practice6where applicable.
Contracts should not be let on any basis that incentivises additional charges, eg ‘income from parking charge notices only’.

If UKPC is not a "rogue contractor"

Sorry to intrude, but may I ask if the DVLA ban on UKPC still applies, or has it been lifted?
  • I believe it was lifted in Nov last year

Both bans in the last year were alas only temporary. If you have your own private parking issue then you should read the Sticky thread for NEWBIES and start your own thread if you have further questions.

Thanks. My question has been answered (sadly not the answer I hoped for!).

No current issue. It's just that I sometimes use a car park which is now administered by UKPC. If you pay for a full day's parking (£6.50) they only give you till 2359 instead of the full 24 hours from arrival. It's opposite a station and I sometimes use it in the evening, but the last train gets in after midnight. You can't just pay for an extra hour because it's timed from arrival. I was just hoping I could ignore it. Don't mind paying a fair price but object to paying two full days charges for an evening's parking.

good to see that you have started the appeal before the deadline

I would get back to that estates person and insist that they ESCALATE your complaint to the people resonsible for hiring UKPC (the organ grinder not the monkey)

alternatively, they should provide you with the name and contact details of this person in charge at the main office or trust (he or she who must be obeyed)

also ask where you send an FOI request in order to obtain details of the contract and to obtain details of which parties have signed it because it seems to breach the 2 year old directions of the DoH and of the guidelines issued by Jeremey Hunt himself

a separate FOI as to how many times they paint the car park bays and when they were last painted would also be worth knowing (poor bay markings - poor signage)

be assertive , be a thorn in their side , make them want to make you go away (and to cancel the parking invoice)

also take this to your MP if necessary , and do the FOI too

I don't want to divert this thread any further off track, but I'd be raising the above issue with the Train Operating Company (copy in your MP too) and see how they respond. Would be interested to know that - but please start a new thread for any subsequent discussion/advice.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I would, but it's private land so nothing to do with the rail companies sadly.
