Was told but my insurance to claim via mine and they would claim back ?
Have got second body shop to look at the car and they have quoted subject to striping £2800
Have to wait until get final position letter and then will put in hands of ombudsman and see if they think it is un-fair?

Yes, I understand could repair at lower cost with second hand parts but no repairer will guarantee repairs like this and why should I waste my time to do so.
I have already told their engineers that I would consider the salvage but It also has electrical issues with the rear door lock and engine management light?
so would be a risk so told them will only consider if viable for time +money
at no point have we discussed the market value of the car

So you want them to write it off?at no point have we discussed the market value of the car
That's rather key to the write-off-or-not discussion.
Seems to me that the easiest solution would be to take the money and sell it unrepaired.0 -
So I accept £1500 and sell for less than £1000 how is that fair to me ????? £2500 for car worth £3500 +

If they will not / cannot repair then give me fair value for car I should not be worse off
I have had this car only for a few months so am not too attached to it so am happy if scraped or salvaged
the issues with repairs electrical / not being striped / hidden issues means I would only consider keeping

Insurers sometimes add additional terms to imported cars such as yours eg cars that are not officially imported by the manufacturer due to the potential problems obtaining parts.
Are there any additional terms relevant to this matter in your policy?0 -
No import clause that I can see
Looked on eBay Gumtree Autotrader Etc and found lowest price for similar was £3500 to £6495 ?
and one was on damaged on side no running issues for £1000 I have done my home work on the values
as said am member of owners club for 10 years plus and have owned 3 Elgrands

I agree, you shouldn't settle for a poor deal! The idea of insurance is you either have yours repaired or you are out in a position where you can buy a like for like.
Problem is with claiming on your own policy there may be terms you've committed to contractually. Go directly to third party and its a bit more black and white.0 -
That is the plan if ombudsman dose not resolve but if cancel claim now they will not get involved as only protect you on you own insurance !
the value of salvage is based on real costs quoted to me buy an NFU Independence motor engineer /inspector
that was visiting where I work last week. and ten years interest in what they go for as have a search set up on several sites.
His advise was to go via ombudsman first then other insurer and direct qoute "There being dicks about this"X Navy trained Engineer now working on Mules / Quads for Kawasaki for last 16 years

You have been misinformed about using the ombudsman.
Before getting the FOS involved you must first make a complaint to your insurer and await their reply (or allow them 8 weeks to reply).
If you get no reply after 8 weeks or they do reply but you are unhappy with the reply you can then escalate the complaint to the FOS for their adjudication.
(As you have been told the FOS can only help over dealings you have with your own insurer and not with any problems you have if not claiming against your own policy)0
