"parts not available" insurance low pay out ?

Have issue with my insurance company Privilege.
Had no fault accident on 13th July with damage to rear of my Nissan Elgrand MPV
Made mistake of taking advise and claiming via my insurance
Also other driver is inquired with same group
Took to approved repairer to get looked at (not stripped) and was told next day that cost was near £3000 and parts not available so no point stripping and they would contact insurance engineer to discuss.
After a week I had call from engineer saying he had looked at repair and had re-engineered the quote to £1500 and that is all the company will offer!
Have had many fruitless discussions with engineers at the company and claims teem only to be passed from pillar to post to find no way forward?
Keep saying clause in MY policy re parts availability saying will only pay up to last known UK price list But not MY policy I am claiming on His
Have had second independent garage look and that say at least £2800 subject to parts availability and stripping
Can I have someone wreck my car and walk away only paying less than 40% of the value?
Car is unsafe to use rear door will not latch
Any advice other than Ombudsman???

    Your post is confusing.

    Is your car a write off? If so you should be paid the market value less your excess and any outstanding premium.

    If it's getting repaired then the cost is not your problem!

    When Saab were on dodgy ground we had a year old car that all it wanted was a new bumper couldnt get one they had no option but to write it off. Basically if the bits cant be got for your car how do expect it to be repaired plus been such a obscure car it maybe difficult to value it correctly firstly how old is it milage condtion pre accident etc?

    You can still get parts for cars made in the 1950s, ok they may not be new parts but neither were the parts damaged on your car.

    This whole 'can't get the parts' attitude is really just a smokescreen for 'can't be bothered with it just have some money and buy another one'.

    I bet if someone really tried the parts could be found.

    Claim on the other partys insurance then.

    But they'll probably just write it off though! They pay market value though so why do you think you will loose?

    The repair cost has been halved by their assessor to £1500
    And they are offering only the cost of repair that cannot be done as recompense for the damage
    They will not discuss value of car as could be repaired if parts were available ?

    The first problem you have is that if you are claiming from the other drivers insurers the ombudsman is not open to you. They only deal with complaints against your own insurer.

    The vehicle looks to be an import have you looked into the cost of importing the parts needed for repair and giving the quote to the insurer. I know it probably feels that it is not your job to do so but unfortunately this is often the reality of owning an unusual vehicle that main stream insurer repair shops are not equipped to deal with.

    As it can't be repaired, I would expect the small claims court to award you the full value of the car, were you to take that route. Other more legally qualified people might be better informed.

    You have contradicted yourself.
    You say you are claiming on your insurance then later you say you are claiming on his insurance. It can't be both.

    The problem is that you've got a vehicle that's never been officially sold in the UK, so there won't be any "last UK price" for the parts.

    You say that they're saying they'll pay £1,500 and close the claim - but on what basis?

    Are they writing the car off and taking it away? If so, you should receive full market value.
    Are they writing it off and you keep it? If so, you should receive market value less the salvage value.
    Are they not writing it off, but paying you an allowance to get it repaired privately? If so, you should receive a fair cost to get it repaired in lieu of the insurer repairing it themselves or writing it off.

    It's entirely possible that £1,500 IS a fair repair cost, once you get beyond insurance rates for labour and dealer prices for parts. Assuming it's the commonly-imported first-shape Elgrand, it's at least a 15yo vehicle. Sourcing used parts for the tailgate, bumpers, lights etc is far from unreasonable - and probably won't be that difficult, once you locate the various specialists. For that kind of initial repair estimate, I'm presuming that's all the damage is, rather than anything structural.

    I don't think the OP is contradicting themselves at all, like many people this sort of event is a once in a lifetime event, panic and confusion reigns, insurers take full advantage of that.


    wildrat, having been through similar recently and am in the process of taking my insurers (Esure) to court.


    I and probably many others do not know this car, is there a UK model which is similar? you may have to base your replacement value on tracking down some examples with similar age/mileage etc
