Received a PCN from CPS (Midlands) Ltd on car windscreen asking the usual £100 but reduced to £60 if paid within 14 days. At this spot they charge either £1 per hour or a flat fee of £4 all day from 7am to 6pm. Time recorded on vehicle was 18.18 and car park empty apart from my car. I am the keeper. The signage isn't great but I need to check the wording. Unsure if you A) aren't allowed to park after 6 (as said previously it was empty) or B) you are supposed to pay £1 per hour after 6pm.

I read previously (older posts dated 2012) you saw this company as a bunch of scallywags but I believe this company are now regulated by IPC so we cannot ignore? I know you say they don't accept mitigating circumstances but for your info driver arrived at the car at 17.50 to find keys weren't in bag. Had to walk back to the restaurant to find they must have slipped out of bag and luckily were still down the side of the seat. Didn't get back to car til 18.25 (long walk there and back).

I would normally use the softly softly approach explaining the above and asking for leniency on this occasion, this has often worked in the past (I have never dealt with this company - first time) but I understand these guys just want the money.

I have read the threads "Newbies in Parking Fines" but some of it I found slightly confusing?

I would therefore like to confirm that you advise not to appeal for at least 3 weeks? Is this to see whether they write to me as the Keeper? Do I appeal as the Keeper after 3 weeks even if I don't receive the Notice to Keeper? And if I don't receive do I let them know they have screwed up (politely of course:mad:) Would I at some stage have to identify the driver - can they force me? When I appeal, which template should I use for an IPC member?

Out of interest have you helped anyone who has had dealings with this firm?

***I'm a strong cookie and I will fight them all the way on this!! I'm a 63 year old pensioner and my money doesn't come easy!

    All your questions are answered in the newbies faq thread


    You are dealing with an IPC company (ie no POPLA).


    So just send the appeal in the newbies faq (black type) then ignore everything you get except a LBCC/LBA or court papers


    Do a search on here to find others who have dealt with this lot

    So can I get this straight? (I'm pretty wise - I just need to wise up on this!)

    My PPC is a member of IPC

    My car was parked 18 mins over the 6pm deadline (for good reason) my PCN shows "No valid ticket" although the all day ticket was purchased and the times show 7am to 6pm. The car park was empty so again I'm not sure if you are
    a) not allowed to park there after 6pm (which would then not require a ticket and is not causing them hardship) or
    b) if you have to feed the meter with more money (I need to clarify this with their notice). Although again the car park was empty so no hardship involved?

    c) Do I wait 3 weeks before appealing? Is this to see if a Notice To Keeper arrives?
    d) The notice says not to correspond by email - your advice says I should email appeal as "The Keeper" which makes sense as letter may not arrive within the 28 day appeal limit? In your experience will they respond to email?
    e) As the PCN states "no valid ticket" do the points in your template letter still stand or do I need to add the reason as to the drivers late return to vehicle or change the points in any way to fit my appeal?
    f) Do I have to reveal who the driver is at any stage of the appeal? Can they force me?

    you appeal around day 18

    no NTK will arrive until after day 28 and before day 56 if they wish to invoke POFA2012

    they CANNOT get the keeper details from the DVLA until 28 days have elapsed, so there is absolutely NO CHANCE of it arriving in 3 weeks or less , or 4 weeks or less for that matter

    you appeal using the methods they tell you to use, its that simple

    the IPC template is normally used without any changes

    mitigation wont help and in any case the driver is not being admitted, so neither is their excuse and the PPC wont care anyway , they almost always reject all appeals , no matter who the PPC is

    no and no to point f)

    Since my last post I have been reading up on others who have had the mis-fortune to deal with this company and their PCN's have stated that they can use the POPLA appeal because this company is a member of BPA .

    However, on the PCN I have it mentions if I want to appeal I must use the IAS as the ADR scheme and that if I want to complain about them I must use the IPC. Is anyone aware of this company CPS (Midlands)Ltd no longer being a member of the BPA and changing to IPC or is it possible they are members of both (or have I been given an old ticket)?

    How can I find out who their membership is with so that I know which appeal template to use? I have looked on both websites and I cannot find a mention of them on BPA Member list but cannot find a membership list on IPC.

    The PPC are BPA and IPC members, but are IPC members for the purpose of ADR, so you use the IPC template from the NEWBIES thread.

    The BPA website is currently down, but you will find CPS Midlands on the IPC website.
