old ticket being chased!

Here's one for you... Parked correctly in the bay years ago in partners car, bought and displayed a ticket but because I was stressed entered my own reg number instead of my partners when putting the reg in the machine. No ticket was issued on the windscreen but started getting incorrectly addressed letters a few weeks later.

Had a few letters, with the correct reg but incorrect name for my partner. Ignored all the letters. Nothing happened. Now a couple of years later they are issuing final demands via a legal parasite firm and threatening court and CCJs etc. Any advice how to play this one please? I'm not sure I've got the ticket that I bought anymore. Considering they can't even get the name right on the threats by letter I'm thinking about continuing to ignore them... The latest letter appears to be a letter of claim.

    I suspect its from BW LEGAL on behalf of either VCS or Excel

    in any case , treat it as an LBC and respond accordingly

    but there have been DOZENS of similar threads on here recently, meaning there are hundreds if not thousands of these letters going out at the moment (especially since Beavis lost in court again last year)

    use the forum search and BW LEGAL to see many similar threads

    If this is BW legal there are lots of recent similar cases here and on pepipoo. Do a bit of reading and then come back when you have a clearer understanding of the scam.

    But how can I respond to a letter that is not addressed to myself or my partner? It was only opened by mistake.

    it should be addressed to the registered keeper, the person whose name was on the V5 on the day of the parking incident (your partner according to post #1)

    that person, presumably the RK , should respond

    if not , a court claim will arrive in the name of the RK

    yes but the name on the letters they are sending is incomplete. I'm not saying it would be impossible that they may correct this error but it is nevertheless present on the LOC.

    if you wish to ignore our advice and have it out in court after an MCOL is issued then fine , sobeit

    but I doubt that such pedantry will stop this going ahead and if a judge were to deem that one of the people in the house was the person they were after then they may not see it like you do

    on the other hand, they may throw the case out due to incorrect paperwork

    if an MCOL does arrive, they may well do proper checks and the MCOL may arrive in the correct name

    I'm not ignoring your advice which I value and appreciate. What I am doing is simply trying to give you a picture of the situation without posting all the private details online!!!

    but you are asking the impossible here, only a judge can decide the outcome , at the moment you are assuming the MCOL will arrive in the wrong name , nobody will respond and the incorrect name will receive a CCJ in a few months time , registered at your address, therefore possibly blacklisting the credit file for that address

    a judge would expect the householder to open the mail , contact the PPC and/or the debt collector and try to sort it out , as court is the last resort

    so if an MCOL arrives and it goes to court , if the judge asks your partner WHY they did not try to sort this out earlier by contacting the PPC and debt collector and correcting this obvious error in the spelling of the name of the RK (lets assume it said Mrs M Lesley instead of Mrs M Leslie) , what is the partner going to say in his or her defence ?

    a judge may take a dim view of the householder/owner/keeper not contacting the companies beforehand , especially at LBC stage to try to sort the matter out

    a standard reply of "not known at this address" would be the usual reply ? surely ?

    I suppose when Jeffrey Archer was prosecuted the paperwork may have said Geoffrey Archer, do you really think it would have made a difference ?

    And out of interest how does the name appear on the V5c for the vehicle?

    Just to pick up on an otherwise very good post ... addresses don't have credit files, only people do. Yes, there can sometimes be "guilt by association" but credit reference agencies shouldn't be doing this, and must correct any errors (once notified) if any such negative links are made to peoples' credit files simply because they share an address.
