Which section are you referring to? The only part I can find that seems relevant is Part V Section 84.
    Interfering with the mail: general.

(1)A person commits an offence if, without reasonable excuse, he—
(a)intentionally delays or opens a postal packet in the course of its transmission by post, or
    (b)intentionally opens a mail-bag.
(2)Subsections (2) to (5) of section 83 apply to subsection (1) above as they apply to subsection (1) of that section.
(3)A person commits an offence if, intending to act to a person’s detriment and without reasonable excuse, he opens a postal packet which he knows or reasonably suspects has been incorrectly delivered to him.
(4)Subsections (2) and (3) of section 83 (so far as they relate to the opening of postal packets) apply to subsection (3) above as they apply to subsection (1) of that section.
(5)A person who commits an offence under subsection (1) or (3) shall be liable on summary conviction to a fine not exceeding level 5 on the standard scale or to imprisonment for a term not exceeding six months or to both.

Bold red is my emphasis. Feel free to show me where in the Act it says I committed an offence. :)

OK, so that's that clarified, it's post-POFA. And I don't see how anything that is missing a surname could be considered validly served.

Are you sure what you have is a LBC? Does it expressly say so? Does it categorically state that they will begin legal action, or does it use weasel words such as they may begin action, or that they may seek their client's instructions or some such rot?

It is titled "letter of claim". Although I can see straight away that they haven't actually given me the claiments address, only the name of the company and their own address.

OK so respond robustly clarifying the keeper's name (not saying who was driving). You will see umpteen dozen threads all over the forum about how to respond to a LBCCC, loads on every page, we get too many. All the same but with advice and example responses.

People who ignore a solicitor's letter at this stage, are (we have found) MORE LIKELY to get a court claim. So respond, and again when they reply with some old drivel.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
