    No they wouldn't. It's down to the OP (or in practice the credit hire company who are pursuing the claim on his behalf) to prove the need for a credit hire car. So if the documents "disappear" then the hire company doesn't get paid - or at least they only get paid at standard car hire rates that the likes of Enterprise would have charged.

    ...and part of the agreement you signed with them will almost certainly hold YOU liable for their charges if the other insurer do not pay.

    Not normally.

    You only end up being pursued if you breach the contract or have not told the truth ( regarding the incident or your own circumstances)

    Unlikely.

    Generally you are only liable for the charges if either (a) you mislead the credit hire company about the strength of your case before accepting the hire car (eg by lying about the circumstances of the accident, or about your wealth) or (b) you refuse to assist them in pursuing the claim, eg by providing bank statements or by turning up in court.

    Other than that the risk that the case will go the wrong way and that the insurer won't pay up is one that the credit hire company takes on themselves - which is why they're usually only interested in clear cut cases where there's little risk of not getting paid.

    Just to add, the other parties Insurers, will be paying particular attention to this claim to keep the costs as low as possible. This is because they will ultimately be chasing the mother to reimberse them for their outlay which by the sounds of it will be approaching £100k.

    In these circumstances, they have a duty to the mother to ensure all costs are kept to a minimum so they will be making sure everything is correct including checking your statements to see if you could have afforded to finance a normal hire car yourself.

    P.S I'm not sure why you're mentioning not hiring a van as it was your car that was written off and not your van

    You make a point that I'd be inclined to agree with, but what's the alternative?

    I think it's safe to agree that we all think it's right & proper that if you or anyone is getting a hire car, we do our reasonable best to ensure it's for a reasonable price - as another poster said above with the example of Enterprise, if you genuinely can't afford to pay up-front for a hire care, then that's ok - you go the credit-hire route (as you did).

    But just consider - if *you* don't provide your statements to show that you were not able to afford to pay up-front, then who else can do this leg-work?

    The people whom you "pay for a service" would need to have access to your bank details and to be able to see your statements, which I think is something that neither you or I want companies to be able to check up on as it suits them... ;)

    Yes, but these so called 'claims management companies' never suggest to you to find your own hire car as that would be much cheaper do they? No, they make as sure as they can that you take their own hire car. It's only after you've been through the mill that you realise how the game plays.

    Most people reporting an accident just do what their insurer tells them and if they say 'as it's a non fault claim you use our partner xyz and you won't pay your excess or lose your NCB' then thats what most normal people would do thinking it must be best. They don't realise they are being palmed off to third party claims companies who will bump up the cost of the claim and are only really interested in making you take an expensive hire car.

    I know atleast one of the accident management companies have insurance in place to cover the cost of credit hire cars if they can't fully reclaim the costs. This means that the client will never have to pay the cost of the car but they will need to co-operate with them.

    Plus providing bank statement isn't exactly time consuming or hard work. It would take me less than 30 minutes to print off statements for all my accounts and I have many!.

    So what happens if it turns out that you could have afforded to pay for a regular rental car at a much cheaper price but didn't because the claims company never suggested it?
