    ^^ This is exactly the situation i am in :( my case is going to court as the OP. The third party is disputing the cost of the hire car.

    I did not know any of this (how should I?) I was told i would be liable for costs if I hadn't told the truth or don't help them with any claim (happy with both those points) BUT i was not told I would be liable if it turns out I could have paid.

    I am really worried now as bank statements will probably show I could afford to pay :( but I was told I will not need to pay for the hire car, so why would I choose to pay when I didn't have to? I might lose my case yet so if I paid I would be out of pocket but as I used the hire car I don't have to pay whatever the outcome.

    My car was a ford focus that was written off, they gave me a 2008 peugeot, I explained when they dropped it off that I use my car for work, I'm a self employed gardener, at the time id been only doing it for 4 months so I was building myself up, using my only vehicle for everything aka kids to school shopping and lugging huge bags of weeds around, the guy said I could of asked for a van but of course I needed the extra seats.     Its just made me angry as in my claim as when you insure a car you expect at the time youd get back what you insured the car for, id insured it for £1400 I had no choice but to take £800, because I could only look for private cars not garage car to appeal my case. ( Another lesson learned ) I was asked if I wished to claim loss of earnings I ummed and arghed, but figured it wasn't a huge amount and the stress of court etc would make me ill to work, so I didnt but it is noted in the police report.

    I was assured none of this would be at any cost to me. This was a question I did ask at the time. was told I could have car for a round 4/5 weeks, It was nov not best time of year and there was no way I was going to find a car from a garage for £800.

    Now this has dragged on. Felt practically harassed and threatened as well what with the "failure to comply letters I will have no choice but to leave your case " blah blah I paid for legal cover yet i'm dong all this

    I Noticed when I looked at the hire car details the cost was £75 per day, I said it was a bit steep, I didnt twig then as the guy who dropped it off shrugged his shoulders saying thats insurance for you, no matter the 3rd party insurance will cover it. So I did look and question a few things. I felt assured everything would just go through insurers

    £75 x 7 =525 x this by 4 is around £2,100.( though kindertons want over 3k, so maybe i had car longer, Not gone through my file today, to stressed to look at it fully right now) Now ive rung round 3 local car hire places today, 2 are independent one is enterprise, They all come to around £1200ish as there is no way id hire a car without the extra waver for 4 weeks plus youve got ave £250 to £300 deposit.

    police report does state im a single self employed mum with two kids, with health problems who used her only vehicle for everything. Yet judge said i'm to prove it. Just makes me feel like I've done something wrong. Perhaps if I was in the car and not woken up at 3 am to a huge bang knowing something was wrong but my body panicked and refused to work for 5 mins, to finally look out the window to see 7 cars totally smashed up. I may of felt different. I mean they of course accepted liability The kid run off and was found walking home ( it does amaze me how he got out. my son saw him run out the car and run off ) also amazes me there were three witnesses too.

    You get the market value of the car, unless you've taken out an agreed value policy.

    You were happy using a mid-size car for your work. You were provided with a mid-size car.

    wasn't a case of being happy using a mid sized car for work thats called making do lol

    But yes I was fine with being provided with a like for like, Its what I expected and actually have read. I signed up for courtesy car cover just not for the current small print which I think should be made a lot larger. Just at the time of drop off, I explained my job, for which he said you cant really use the hire car for gardening you should of asked for a van, I said really, he said yes if I had asked. sooo not sure if he should of said it tbh, and of course a van would be more expensive to hire as well. just as well I said no to that with current state of things

    The judge will award the lower standard rate i.e. the High St rate that you could have obtained if you walked off the street and paid up front.

    What happens with the difference is down to you and the credit hire company.
