Inapickle- thankyou so much for your advice and to everyone else too, its all so helpful and im definitely going to fight for my job, or if not my job then they can expect to see me in a tribunal, basically! I am registered disabled yep, spina bifida is a disability that's covered under all the acts. Sad thing is i work for a home where i work with people with learning and physical disabilities so youd think my employers would be more understanding than most but sadly not!! I will definitely be mentioning all the acts, equality act i believe is also relevant here. Im gutted as its come at the worst possible time, after my parents divorce, our dog having to be put down, my grandad being diagnosed with cancer again (after he beat it before and was in remission), falling out with half my family due to the divorce, and finding out my condition is degenerative, will paralyse me eventually, and i need more major surgery soon i didnt think things could get any worse, but clearly they could. :mad: My sick record is really good so i dont think thats the problem. Ive hardly had time off sick in 4 years, literally only a couple of days where i had d&v and then 3 months for spinal surgery, thats been it. My colleagues have had much more than that off work. I drag myself in most days in severe pain & deal with it and i do my job and what needs doing and i don't let it affect my work, because ive been brought up to get on with it because i need to work, i cant handle the thought of having no job. Being on benefits is not really what i want!
my work are saying that they dont want me working alone in the independent house "in case my disability causes me to fall" and i quote "you might fall on a resident and injure them" and also "its not the residents job to summon help if you fall over". Yes i am a fall risk as is anyone with a disability, BUT anyone can trip and fall, common sense would be you check the area you are working in for fall hazards and remove them. I suggested an alarm linked to the main home, which they should really have anyway, not just for the carers but in case residents need to summon help for themselves! or me wearing one of those personal alarms which i said i would happily pay for myself if it meant i could carry on working there, but they arent having it. They wont consider altetnative employment either. Ive asked can i move to kitchen assistant instead as ive covered a ton of those shifts with no issues, its do able for me as its a small laid back kitchen, all you need to do is chop/prepare food, cut up meals for residents, washing up and drying pots, laying tables. But they said they already have staff for that and wont consider me, its part of a big company with several homes that staff move between and they just wont consider finding me an alternative role either :-/ which i also believe they have a duty to if possible, so i will be bringing that up too!! I spoke to CAB yesterday and they said im being discriminated agsinst. I have an a
appointment next week to speak to an advisor and have requested my work change my meeting date as is my right (says in letter i can if necessary) so hopefully they understand that i need to get advice first and arrange a suitable companion. I was only given a few days notice of the meeting yet the letter is dated back to july so i wouldnt be suprised if my manager conveniently forgot to give me it until the last moment. Not only that but she opened the letter and read it in front of me before i even got my hands on it myself, which im going to mention too because it was addressed to me so she surely had no right to open it and read it first without my permission too? I was like :eek: and then :mad: .
The worst thing though is that i am devastated at the thought of habing to leave my two residents who are like family to me, snd whom have come to trust me. Their families are supportive of me and trust me with their son and daughter too and i speak to the families regularly.im their keyworker and it breaks my heart to think of leaving them behind. I dont want them thinking its their fault ive left them. I really wish my work would consider the impact on the residents too, they need continuity!
plus nobody really wants to do the sleep in shifts, especially the weekend ones which currently i help out with - which will mean my two going to slerp in the main house more often wgen i leave until they eventually find someone to cover - this is unsettling for them too and its not fair, they should bevin their own beds. One of the residents' mum said to me on phone that she hoped i would stay for a long time as 'so and so really likes it when you are working', i said to her ' dont worry i dont intend on going anywhere' this was before i got the letter! Im going to be letting them all down and thats horrible

I am very worried at how badly they are treating you. I mentioned that I had been through a similar issue. You need legal representation with you. The processes sound grossly unfair. Moreover, you can ask to delay the process in order for a representative to be with you.
Your employers appear to be trying to bully you. It is debatable if higher up management nationally are aware or condone their managers actions.
I speak from experience bring some one who is trained in empoloyment issues with you and your management will soon back down. I left soon after but I was able to choose when and prove that i was Your 100% correct. your managers appear to building a fine case of intimidation and discrimination against you. Don’t let the situation get you down. You will be ok and stronger for it. It is a disgraceful treatment of an employee, I hope that you take my advice and seek legal advice (expensive but worth it).
I thought of the kindness you spoke of when giving a small gift from the stash a month ago or so. I was inspired by it and put back the brush container and bought something for a person who is going through a really rough week.0 -
I posted my last update without properly reading back through the thread and have just caught up on Gemzie121's situation. That is absolutely despicable behaviour. It seems clear to me that you haven't let your condition affect your work, I don't understand how your management can possibly think they're on the right side of this. I'm not going to pretend my management is perfect - it's not! - but they've known I have joint problems for a while and when I told them I'd actually had a diagnosis of osteoarthritis and hypermobility the first thing they did was ask if I needed any adjustments made.
Management should be enabling you to stay in your job - which judging by the feedback from relatives you spoke of you're very good at - not trying to get rid of you. Especially when they've known all along about your condition! Is the company you work for big enough that it has an Occupational Health department of any kind? I work in the NHS and anything to do with reasonable adjustments etc is done through Occ. Health. They're there to keep you in your job wherever possible and they shouldn't pander to management. They work for the employee.
I don't have any specific advice that is any better than what has already been said but I really feel for you. I think you've been put in a horrible position because even if they back down, you're in a job where you know the management have tried to have you dismissed. It makes it so much worse that you obviously enjoy your work; you're not there purely for the pay cheque. They should recognise that you're a committed and generous employee.
It sounds like you're doing all the right things. I think having as much information as possible from various places - CAB, unions, etc - will prepare you very well as this moves forward and I hope you can keep your spirits up.
I also think it's lovely that while you've got all this rubbish going on you're making up presents for other people.
There's not much any of us on here can do except offer advice and a friendly ear, but I'd give you a job if I could!0 -

Employers dont realise how stressful it is and how it affects your life outside of work too. My meeting is now next wednesday and ive contacted unison to see if its worth me joining as they have a disability rep. Hoping they reply tomorrow as couldnt get hold of them today. Im just annoyed that this not only will agfect myself and my family but will affect the poor residents i support too, whos lives will be unsettled by me going. I wish they had considered them too

Savingfortomorrow - im really sorry that you e been through this tooand Deleted_User - your employers sound fab, i used to work for NHS too in health records and they were so accomodating, i loved it there, unfortunately it was a temporary contract and they had to let us go at the end due to budgets and no money to keep us, they wanted to make us permanant but couldnt
ive been looking on NHS jobs but so far haven't been given interviews wheh ive applied and a lot of contracts also seem to be 0 hour ones now. :-/ mum works in social services and she did say a lot of jobs are gone before they are even advertised :-/

Used a bit of christingle tonight af swimming after some lush freeze shower gel and they killed the chlorine smell = result! Cant stand chlorine! Might save my precious freeze and get some dirty springwash for swimming when i get paid from work next week. Thats it then until ive moved house as ill just be adding to the stuff we have to lug and move!! Expecting a few more parcels from swaps and a couple of bought items and i will have a parcel to send with a few GAs in soon but thats it. I cant buy anything else after this week anyway in case it doesn't turn up before we move, so hopefully my bank account will be happier this month!! Plus im goibg to need to budget for curtains for the patio doors in my new bedroom when we move etc - need to save for a few bits and i dont need anymore beauty items!!

I had a nail polish declutter last night, I threw away a half used mini bottle of Nails Inc Westminster Abbey as it doesn't suit my skin tone and chips easily. I am giving 9 other hardly used polishes to the CS, they include Avon Gunmetal, C&E Mica, Ciate Locket, Models Own Ibiza Mix, 2 x Bourjois 1 second polishes, a mini OPI confetti glitter, Sally Hansen Champagne Toast, I can't remember the others.
I also have about 10 bottles to try out and if I don't like them they are going too.Debt Free and now a saver, conscious consumer, low waste lifestyler
