(although this is a good thing for the sake of my bank account and the purpose of this thread!) we move house at the end of this month, plus i want to save to get a puppy, and also ive just found out my work are wanting to "terminate my employment" on grounds of "capability to work due to ill health" basically they want to get rid of me due to me being physically disabled. Yet they knew the score when they employed me 4 years ago. Ive worked there 4 years, hardly ever off sick, never done anything wrong, etc. my doctor was concerned they were giving me too many working hours/shifts in a row and requested an assessment to make reasonable adjustments. They were giving me more hours than i was contracted to do and it was too much for me and doctor wanted them to keep to my contracted hours and allow me extra breaks and split up my shifts a bit more so i wasnt working 5 or 6 days in a row. Unfortunately they arent interested in making any adjustments and would rather just "terminate" my employment. I really need my job and im devastated it has come to this, but we are going to fight it. I work in care but i work in an independent house with no moving or handling. My mums a social worker and she thinks ACAS will have a field day with it. I have a meeting on friday during which they will agree upon whether i am to lose my job or not. If i lose my job it could take years to find another - sadly employers dont usually like emplying disabled folk as they think we will be off sick all the time (ive been off less than my able bodied colleagues!). It took me years to find this one and whos going to employ someone whos been sacked already due to "ill health"? If i lose my job ill not be able to pay mum any rent, will lose my car, my mobile phone, any social life i have left, my dream of having a dog again, my independence and my pride. I cant afford to be on less than 200 a month on jobseekers it wont cover my bills :-/ I feel like im being written off as useless yet again because i happen to have spina bifida
really need to get some advice this week from disability rights. Been told if i join a union it only covers you from the day you join so thats a waste of my money :-/
*Seeths* This is absolutely DISGUSTING! :mad: Has your employer ever heard of the Disability Discrimnation Act? This runs absolutely contrary to it and they are about to get hauled over the coals in a most unbecoming fashion.
I'm assuming that you indicated this when you applied. Did you write it on your application? Ask for a copy of it from your HR records.
I have been told that any long-term illness or condition that is not even specifically named in the DDA can be counted by virtue of being a long-term condition. Check that out legally.
I just G**gled 'is spina bifida covered by the disability discrimination act uk' and the following came up, which would indicate that it definitely is. Precedent has been set. Get in there and don't take any messing:

This. A thousand times this. Does your workplace recognise unions? Can you bring a rep in? Do you have one? If not, get one. They are the new Chanel No.5.
From what you have said it sounds as though you have a reasonable sick record. Under the circumstances it would be reasonable to ask their parameters on sick leave in writing if it is not specifically specified in your contract of employment (how much is too much?). Ask if other employees who have had the same amount or more sick leave as you in any defined period (i.e a calendar year) are being subject to the same restrictions. If not, it's discrimination - pure and simple.
If you know of any other colleagues have had more sick leave than you have, ask if they are also being subject to the same rules. They will say that they can't discuss another person's case, but watch body language etc. and remember/write down EXACTLY what they say. If later questioned you can relay events as factually and detailed as possible in any statements that will constitute written evidence on events.
Remember, your doctor's note constitutes medical evidence as to the necessity of these alterations.
Get legal advice, if possible. Many Legal Aid solicitors run a free half hour initial consultation. It's not long, but if you are well-prepared could give you answers you need.
See if there are any online forums for people with spina bifida where you can ask questions to people who may have had similar issues and how it was dealt with.
When all of this is over find a better company to work for a run. Make it clear in your resignation letter that you are leaving as you have felt discriminated against on the basis of disability and if you feel that this whole event has had longer-term repercussions make sure your resignation letter reflects this.
Gemzie, you are absolutely and completely legally right about this. It's just a question of how sue-able your employer is prepared to make themselves before they back down.
Chances are, when they realise the size of the gun barrel they are staring down they will blame the 'rogue employee' who was misinformed etc. and will be 'had a work with'.
Check if it's worth lauching some form of internal grievance and/or speaking to HR.

UU: Body Shop Banana Shampoo WNBA - It smells great but doesn't do anything amazing to my hair. Probably would buy if there was a very good offer on or if it was heavily discounted, as it's £5 a bottle.0

John Freida Luxurious Volume shampoo - my hair got very greasy very quickly using this which made it very lank. Not good for a shampoo meant for fine hair!
Original Source Watermelon and Jojoba Oil shower gel - got this free, but would not buy. I did not like the scent and it had one of those hard plastic bottles that is really difficult to squeeze.0 -

I'm in for August too. Will update my list for July shortly. I looked through my box with full sized items in it and there's very little left. I seem to just be replacing UUS now with the exception of lotions/butters that still need to be worked through. Still got loads of travel sized things though so might not replace my full size stuff next time and work my way through these.
Gemzie - that is horrendous. I echo the advice already given. The best thing you can do is be prepared and document everything that has led to this point. 100% take someone with you as sometimes it's hard to keep a level head and process everything that is being said so having someone else there will help to make sure everything is captured. My OH is still going through the redundancy process and had left the union months earlier. He was told the same as you (not by the union) and didn't want to contact them as he thought they couldn't help but you never know. He was told by a manager to document everything and seek advice from Citizen's Advice. He's now waiting until day 45 of the consultation period to find out if he has a job or not because they don't want to let him go just yet. He's been very clear that he wants the redundancy and that it's putting a huge strain on myself (currently 6.5 months pregnant) and his health (currently signed off work) but they are keeping him in case any of the people who have been picked to stay are successful with internal vacancies meaning they need to backfill into the team. It's an absolute joke. Companies don't realise how much they mess with people's lives. He went through a similar situation when his daughter was born. She ended up being 7 weeks premature and in intensive care for 2 weeks so understandably he's very anxious about this and just wants a resolution so we can move on. To call something a consultation period for 45 days is a joke of no real consultation is taking place. He's said from week 2 he wants to go and they've just left him hanging for the remaining 4 weeks. I unfortunately work for the same company and my work has suffered since this began which was pointed out in my latest 121 but no sympathy offered and it's unlikely I'll be eligible for a pay rise next year due to 2 small errors which had no material impact on anything. Sorry for the rant but I despise big companies! I cannot wait until our business is up and running and I can hand in my notice.
Gemzie please let us know how you get on. It sounds like a very tough job you have - very demanding. It's ridiculous if they think they can get rid of you for ill health if you were upfront about it and your absence is less than others. If they go ahead with their plan I think you have a very good case for unfair dismissal as you've been very accommodating to them and your colleagues (I remember you saying about swapping shifts previously) and all you are asking for now is to work the hours you are contracted for but with a bit more care when they plan the rota - not unreasonable at all. Loccitane face wash WDBA - this was my holy grail for years but I want to try a full collection of the seaweed stuff at The Body Shop. Already been using the toner, day cream and night gel for a few weeks so looking forward to seeing how my skin looks using the complete collection. Straight off I'm not sure I feel clean using TBS seaweed face wash and there's not much difference in price between this and the Loccitane one so might revert back once it's done
Batiste dry shampoo WDBA - love this stuff
Yes to Carrots night cream WNBA - definitely disappointed in this. Had no scent and it was nowhere near as nice as I remember
Loccitane hydra day cream WBA - I do like this stuff but like I say I'm trying a different range at the moment. Not sure I can justify £30+ for a moisturiser so hopefully I like TBS one or can find a decent, cheaper alternative
L'Or!al Elvive colour protect shampoo WMBA - was ok as a cheaper alternative to Tresemme but didn't last as long so back to Tresemme I go

S&G Sugar crush body wash 500ml WDBA - I love this stuff and I love having a big bottle as I feel like I don't need to spend money on shower gel for ages
No7 bath soak 200ml WNBA - I got this free in a set. It was ok but I wouldn't buy it on it's own. It did bubble nicely bit was a bit of a pain to get out of the bottle

Bobbi Brown gel eyeliner sapphire - got my make up done at BB for a wedding so treated myself to this. Been using the black one for years but absolutely loved this colour so thought I'd get this for a change

Johnsons eye make up remover pads- WMBA on offer but wouldnt pay £3 something for them as think normal face wipes take my eye make up off better. These were a little too 'fluffy' too. Still useful for my work bag amd they were reduced to a quid to clear in superdrug.
Avon renew reversalist night cream sample sachets x2 -WNBA as full size. Too heavy and greasy for me.
Sensodyne repair & protect whitening toothpaste- WBA think this is the best ive tried. Expensive but worth it to get some relief! This one isnt too strong and does the job well.
Boots cute or what shower gel mini- WNBA but would use if recieved again, this was from a gift set. Perfectly nice - did the job and had a very light and pleasant scent but if buying gels TBS or lush are my preference.
