bank payed unauthorised payments to Netflix

    No. It's the customer's card that has apparently been used fraudulently and, as such, Netflix have no liability.

    But they have to check the person making the payment is the owner of the card.

    Do they? If the card details provided are correct (name, card number, CVV number) then they won't know any different.

    In theory they should, also the street retailers had to check the person making the payment was the owner of the card (now the pin is proof enough). Otherwise they're risking the card provider (Visa, MC...) could pursue them asking for the money back in case is a fraudulent transaction/

    You're talking about checks that have not been made on a regular basis for many, many years now. I repeat that Netfix have done nothing wrong and that it's Nationwide that need to resolve this, and you're not going to be able to convince me, or anyone else with at least a rudimentary knowledge of the payment system, otherwise.

    I'm talking about debit/credit cards. If the retailer doesn't take measures (such as id checks, have updated devices..) they may be liable for a fraud. I know they don't usually do it but they should .

    Don't be so simplistic, even in the case the bank is responsible for that (we don't know for sure), Netflix should cooperate to find out what happened and don't say "we have the payment right so we don't care"

    Is that just your opinion, or a 'nice to have', or can you show is something that demonstrates that they are acting fraudulently if they don't seek the id of the buyer?

    In case of fraud, the card provider (like Visa) can make the retailer pay for the fraud if they didn't prevent it. The most common example in the past was check that the signature of the receipt matched with the signature in the card. In case they didn't do it and the card owner claim that the payment was not authorized by him/her and the signature on the receipt didn't match with the card, then the retailer may be liable for the fraud. It's just an example, although usually the card providers take care of it as they don't want people to think their payment system is not secure enough, so they pay.
    But the theory is that

    I didn't say or think that they acted fraudulently in any case, just that once the fraud is known they're not doing everything they can to solve it.
