If you believe that the excess on 3rd party claims was not made sufficiently clear to you then you are entitled to make a complaint about it.You might have answered this question a thousand times but my situations in a little different, i have a car insurance police with xs direct and i was involved in a car accident 5/7/15, i was not at fault! I have picture to prove, and where the damage was made on the vehicle, couple months later my insurance was due for a renewal and i asked about my claim, they told me that the claim has been drooped by the other company (london transport, bus) and i haven't got to worry about it, the reason why i didnt claimm is because i dont like dealing with all the paper work and that. 1 year later i received a call from them tell me i owe them £500 odd pounds for paying the 3rd company out, apparently it has went to court without anyone notifying me with any information that the claim was still carrying on. Well i took the insurance out other the internet i wasn't aware of this all excess thing till today, i spoke to them over the phone telling them i wasn't sent y term and condition over the post or it wasent e-mail to me, they turnt around and said well i will send that through the post today? I refused it,
i haven't made a claim against the 3rd company
they said they will cancel my insurance in 7 working days if i dont pay my excess.
And i told them i havent got the money for it now i will pay them next month they have refused to help me with a settlement plan.

This seems like a good forum im hoping someone can help. I have a policy with XS Direct and had a fault claim i have agreed to pay the excess but they are not providing authorisation to the body shop for weeks and they say to me over the phone to book my car in but the body shop has confirmed they haven't got any confirmation from XS which means i would have to pay the entire bill which is higher than my excess.
is there any bodies that govern insurance companies that i can go to? they do not reply to email and i end up calling them all the time and getting told samantha is busy or on the other line, i sense they will try and send me a request to pay for it all, before they do i want to make sure i have a understanding of where i stand legally. DO NOT USE THIS FIRM.0 -
True.I would say they cover this quite comprehensively in several places on their website. Its also mentioned in the introduction in the policy
But, the Op bought through broker OneCall - so is it not their responsibility to highlight this? The Op likely never visited the XS website. Why would he - that is what his broker was arranging for him.
As is clear from the above posts, although not true the Op thought he was insured with OneCall. So that seems to be the question - what did OneCall highlight to the OP when broking this XS policy to him?
By the Ops own admission he may not have understood, but a decent broker should be trying / ensuring he did get it.I am just thinking out loud - nothing I say should be relied upon!
