    Years ago I worked in retail advertising on the MFI account. Retail advertising is cut-throat and mercenary. MFI folded because of one main factor; lack of proper customer service. Hopefully their successor Wren will go the same way.

    14Goods to match a model seen or examined

    (1)This section applies to a contract to supply goods by reference to a model of the goods that is seen or examined by the consumer before entering into the contract.
    (2)Every contract to which this section applies is to be treated as including a term that the goods will match the model except to the extent that any differences between the model and the goods are brought to the consumer's attention before the consumer enters into the contract.
    (3)See section 19 for a consumer's rights if the trader is in breach of a term that this section requires to be treated as included in a contract.

    They can't disclaim liability, even if you have installed it. The old SOGA used to have a section on acceptance of the goods where it was possible to accept the goods if you treated them in a way that was inconsistent with the retailer retaining ownership (ie by installing them) but that didn't apply where the goods were delivered at a distant place - in those circumstances the consumer always had a reasonable time to inspect the goods to ensure they conformed to contract and even where goods were accepted, the retailer remained liable to provide a remedy, the consumer just couldn't insist on a refund.

    However there is no section for acceptance in the new consumer rights act. You have a standard 30 days to return goods that dont conform to contract for a full refund.

    Again, even if the 30 days had passed, they'd remain liable to provide a remedy - the only difference is you cannot insist on a refund.

    Did you specifically contract to purchase a Blanco sink or was it just an assumption on your part that this is what would be supplied as part of the kitchen?

    How much was the sink?
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales
  • We paid £309 for the sink and by reckoning that's anywhere from £100 to £50 more expensive than you can get it elsewhere.


    It just said a Swale sink on the order and didn't refer to brand.

    So as you did not specifically order a Blanco sink I cannot see you have any comeback with Wren. You could check with them that £309 is the correct price for the Swale sink, in fact why not just ask them what is their price for the exact same model Swale sink as yours.

    OK 8 yrs ago and Wickes not Wren, but when I bought a kitchen from Wickes, every single item was listed on an invoice which I signed to say I agreed price and specification before I left the store. I had asked for different handles for the cabinets and these were listed on the invoice and correctly supplied.

    But if you re-read the opening post, the sink OP saw was not a Blanco sink, but a sink with a Blanco nameplate. I still maintain that unless OP actually requested a Blanco sink, she will struggle to claim. And just because I have an Astracast sink (another story) does not mean I am not sympathetic to OP's problem, but I don't see a favourable outcome.
