The op said the woman referring to her as male was sitting next to her at the time. It wasn't just a paper tribunal where something could be missed or misread.Unless I say otherwise 'you' means the general you not you specifically.0

Well if its not important enough to mention to the person next you i doubt the suing will go very well and in this instance I'm glad legal aid probably won't help.
You don't know, I don't know what the situation was, if there was opportunitu to speak, what the paperwork said, what the order of people speaking was so us discussing it is a waste of time.0 -
A tribunal would be very stressful. The OP has BPD - the full name is emotionally unstable personality disorder, borderline type. I have the disorder and it's very difficult to stand up for yourself at the best of times, when you're in a stressful situation and already at a disadvantage, feeling that someone's out to get you (because, in this case, they were). The main aim of the tribunal was to assess entitlement to benefits. It's only afterwards that you settle down and realise what you should have done or said, and that someone was behaving inappropriately.

If that's the case, then why would everyone else (including the judge) refer to the OP as a woman?

As speaking up would have been difficult for ninjastriker, it's a shame that her carer didn't say something. I would have expected a carer to know the distress that being referred to as a man would cause the OP.0 -
I have read everything people has said, and respect peoples view. As previously said, everybody in the room refered me as she and treated me like a woman. It was when I got the paperwork itself, that she decided to refer me as male and a he.
I personally do not see it as a mistake or an error and I think its gone beyond an apology, as she was already aware idendified as a woman. I will look into PALS, press for chane and CAB to see what my options are, but as theey have been discriminating against people for being disabiled, this is the first time I''ve seen the PIP people discriminate against someone that's transgender.
I have attached the paperwork itself, and let you guys decide what my best options are. I only suggest to sue them, because it has made me break down again and my suicidal thoughts got worse, I see the doctor every week, and have a mental health team in place. If it was just the once, I would accept the apology and move on, but as it was repeated, I feel like I should go further, as it was uncalled for.
