It is always better to post your draft here rather than refer to something that people will have to go off and check elsewhere then come back here to comment. You should also always check and amend to make sure the appeal fits precisely your case. Too many people copy and paste and then we find that it has a different parking company or it refers to a different car park so it really needs to be a bespoke piece of work tailored to your own situation.
Anyway, this is the cart before the horse. The first stage is to get the BPA template appeal sent off and see what happens next. Some parking companies are now wise to this and cave in at that point when they see a forum template because they know they will lose at PoPLA . It costs them 27 quid plus VaT for that privilege.

Thanks fruitcake. I only asked the question because after I read the appeal by CM I thought that this version of Euro's NTK had addressed all of the points raised in the first few paragraphs but wasn't sure. I'll be sending the short challenge from your newbies thread initially so I have time to digest all the valuable info on this site.0

So, alleged event was the 4th, PCN/NTK received on the 20th (six days after the letter sent date, so it is outside the 14 day window starting the day after the alleged event for an ANPR NTK to meet the requirements of POFA 2012.

You are so right. Sadly my friend doesn't have the envelope. Victim of the washing machine. The bar stewards have patently lied as you say and back dated the NTK so that the letter date is within the 14 days.0

I'm not seeing a single word along the lines that the driver is liable but that they do not have the name & address of the driver. The bit that should then 'invite' you to pay or give the name & address of the driver, and pass the PCN to them.
Have I missed that bit? It is VERY EASY to compare a PCN with para 9 of Sch 4, any newbie can do it. It's just bullet points not some fusty, detailed law book!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The saga continues. I sent a standard short challenge on the 30th June.
An NTK has now been issued dated the 4th July demanding £70 but no response to the challenge as yet received.
It would appear that they have 35 days in which to respond and now I have a further 28 days according to the NTK to either pay, name the driver or appeal.
Sadly no proof of posting was obtained when the original challenge was posted however, I guess it would be reasonable to assume that the challenge was received 2 days after the postal date same as the NTK is assumed to be received.
Can an expert confirm if I should wait until around day 21 and appeal again requesting a POPLA code as well as pointing out that it is now out of time and no POFA compliance?

I would just wait, as long as the first appeal was done online to ECP they cannot have lost it.
I've noticed that ECP are odd - very odd(!) in that they firstly post a 'PCN' (the thing shown above) which they think is a 'Notice to Driver' PCN,' then they post a NTK. Weird. Very few PPCs do this and Euro have no reason to do it that way - they could save postage and just send a 'NTK' first time!
Either way, the NTK you now have isn't compliant with paragraph 9 of Schedule 4, as covered in other Euro POPLA threads very recently. The work has already been done for you on other threads, ready for POPLA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
