Euro Car Parks. Cathedral Retail Park

Options
Hi Everyone

A friend of mine is about to pay a Euro Parks Ticket as the 14 day period expires tomorrow. Letter arrived 6 days after the letter date.

This car park has a 2 hour free parking, my friend was there fore 3 hours. Given the Beavis result in a similar car park, is it worth an appeal and if so, could someone advise the best grounds please from the regular approach which has been used for some considerable time.

Thanks for any advise given

Your friend is mad - tell them from me!

Read the NEWBIES thread, email ECP the template blue wording appeal. Call himself the 'registered keeper' not the 'driver' (don't mention who parked - that's why I wrote a template appeal, to stop people appealing badly).

No-one here (who has used a forum appeal) has EVER lost at POPLA v ECP! So easy. And they don't sue people. Why the heck of hecks would he pay?!

  • Many Thanks CM. Does the Beavis result have any effect on the chances of success as there was no opportunity to pay for parking so commercial justification may come into play as far as I ascertain.

Beavis is likely irrelevant - I bet that the ECP signage was nowhere near as clear as the PE signage in the Beavis case. ;)

The friend will probably win on no keeper liability IMHO, because ECP do not use PCNs which comply with the POFA Schedule 4. I think if you search the forum for 'Euro demolition job' you will find a thread where a 'demolition job' of Euro Car Parks' PCN wording when compared to Schedule 4, was set out in a fairly recent POPLA appeal or two.

Even if the friend lost, you wouldn't PAY this bunch just because they'll send some more letters!

Not sure if the tinypic photos of the Euro Car Park invoice have uploaded but here's a try.

I have read the demolition job suggested by CM but it would appear they have changed their NTK in an attempt to negate some of the arguments presented.

I hope the two pages are visible to you so that you can advise if possible.

Thanks in advance for any assist.

Just for clarification, in what country did the alleged event occur?

Upload the pics to a web hosting site such as tinypic or photobucket, then post the URL here but change http to hxxp.

  • England. Clearly I'm missing something. I haven't uploaded before and I guess there's something gone wrong because I can't open it. Copied the address for message boards from tinypic but it didn't upload it seems. Think I need some assistance!!

Trying these to see if the links work better than the last attempt
  • It appears to have uploaded OK. My apologies for the delay and not getting it when Fruitcake responded. Thanks for that.

Now that their NTK is visible, would someone advise if the appeal to POPLA done by CM titled Euro Demolition job would still apply. Would it still be as effective without the opening paragraphs which seem to have been addressed.

Thanks so far for the help and hope CM can advise.
