    The dictionary definition of presumption is “An idea that is taken to be true on the basis of probability”.


    It would seem to me that he has ruled out finding the keeper is the driver based on the ‘balance of probabilities’

    The problem is the "lottery court system" whereby judges are still not understanding and make up their own interpretation.
    Judges often get the hump if the parties involved appear to know more than he or she does.

    Until this is addressed, nothing will change

    Not sure what "The Deep's Justice", but I have had to make many hundreds of decisions far more important than this, and only a few have ever been overturned at appeal.

    How many others here have had to make life changing decisions on a regular basis I wonder and so consistently been right?
    You never know how far you can go until you go too far.
  • Same car park. Same sign. Same facts, however, a different judge found there to be a contract in my case today. I am gutted as clearly the sign is one of forbidding nature.
