  • Got a ticket in June 2015- it was a penalty charge notice so I ignored it. Gladstones started contacting me on Horizon's behalf- I still ignored it (the letters didn't look legit and the prices would escalate drastically after every letter). It's not an excuse but I was going through a busy period at the time and had read a lot about these 'Cowboys' so I persisted to ignore. I received a court letter and again thought it couldn't be serious (in my naïvety). Well, a year later I tried to get a home and found out I had a CCJ against me from Horizon parking. I was shocked, angry and distressed. After crying and crying some more (I was refused the house because of this) and a long time spent on the phone to credit agencies and the court, I'm hoping to get it removed so I can start my property search again.
    I know I should've paid the Penalty charge notice but as I was parked on a tiny side road for few minutes, I didn't think they could charge me £40!!! Well, I've ended up paying almost £300 to Gladstone/Horizon/Court/Experian. Absolutely disgusting.

    Please start by creating your own thread on here and make sure you read the Newbies thread.

    No, you should have appealed the PCN. . You can ask for it to be set aside, but it is costly and you may not be successful.

  • UPDATE:

    I submitted my defence, which was acknowledged. I have now received a notice of proposed allocation to the small claims track.

    The notice includes the small claims directions questionnaire, which I shall complete allocating it to my local court.

    I presume that I should NOT ask for the mediation service being that I am disputing the whole thing?

    Sorry for the long delay, I've been out of the country for a number of weeks.

    The claim has been allocated to the small claims track and the hearing is set for 22nd November 2016.

    I have little idea what I am doing.....so I will be doing some intensive reading and panicking over the forthcoming ;)

    If I post up a full defence which I will serve on the claimant, will somebody help me and look at it? I understand this needs to be the same as my initial defence, but builds on it / explains it.

  • My notice of allocation orders that
    2. each party shall serve on the other party all the documents on which he relies by 4pm on 2 November 2016.
    3. the parties shall exchange witness statements of fact by 4pm on 16 November 2016.

    SO my initial defence I have submitted outlines all of my points on why I think I shouldn't pay / this should be thrown out.
    And I was going to write a witness statement which backs up / talks about these points.
    What do they mean by "all the documents"........I don't want to miss filing anything I need to file!!

    For "all the documents", do I send my pictures of the area + any previous cases i am going to talk about in my WS?
