County court threat at incorrect address over PCN from Civil Enforcement LTD

should I be referring to signage I have no idea about
Most appellants have no idea about signs they didnt see and some are keepers who haven't even been to the car park. But the template is one-size-fits-all.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Apologies but I'm new to this site. I've received a letter with photographic evidence this morning. Where can I find the template?0

Hi pappa golf.
Thank you for the link.
Just a quick question. How do I know if the PPC is an AOS member?
Other than that this letter should suffice?
Date
Dear Sirs
Re: PCN No. ....................
I challenge this 'PCN' as keeper of the car and I will complain to the landowner about the matter if it is not cancelled.
I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers before they park.
Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as required under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. I believe the driver may well be eligible for cancellation and you have omitted clear information about the process for complaints including a geographical address of the landowner.
There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.
I have kept proof of submission of this appeal and look forward to your reply.
Yours faithfully,0 -

Hi pappa golf.
Thank you for the link.
Just a quick question. How do I know if the PPC is an AOS member?
,
zoe , please start your own thread
however
any parking Co has to be a member of an approved operator scheme , 2 schemes are running in the UK , the IPC and the BPA , the template letter that you send has to be formulated correctly for each type of AOS
this link is for IPC members , and there is a link to BPA members on it as well https://www.theipc.info/aos-members
but please start your own threadSave a Rachael

I appealed this on 24-06-16 as I was advised on this thread and also informed them of my new address for all future correspondence, however I didn't receive a reply from them after me asking that we address the first £60 letter. I have received 2 letters dated 22-07-16 and 08-08-16 from Wright Hassall who claim to be solicitors, yet when you call them your options are option 1 to make a payment or option 2 for customer service, this doesn't seem like a legitimate solicitors to me. Both of these letter I have just received today as they have once more sent them to my old address which I changed with DVLA many months ago and informed them of this in my appeal letter. The first letter states ZZPS who are acting on behalf of Civil enforcement LTD require me to pay within 14 days of course I couldn't even if I wanted to due to them sending it to the wrong address and me receiving it on 15-09-16 and the second letter stating that unless £236 is paid within 14 days which again due to the date I could not do they will review this matter and may be left with no alternative but to issue ccj proceedings. I contacted this alleged solicitors and was informed their client Civil enforcement LTD had closed the case with them and perhaps I should contact them, yet she could not give me an address or telephone number for them... I have not had a reply from my appeal and have retained it along with evidence it was sent via email, I am enclined to think that's the end of it and I shouldn't contact anyone as I have appealed and used the MSE template. What do you guys think should I contact them or not?Tis better to be thought a fool and remain silent
than to open ones mouth and remove all doubt0 -
Contact the BPA and provide them with a copy of your appeal; tell them to sort out their member.0
