Friend won't refund me

Hi, just looking for some advice from an outside eye.
My friend was selling tickets to a concert, I bought them (paid via PayPal) just over a week ago. She said the venue hadn't sent her the tickets yet but as soon as they did she would post them to me. The concert is now less than a week away and I still haven't received the tickets and unfortunately I can no longer go to the concert.
She is now saying that as I have paid for the tickets they are technically mine and its up to me to sell them on. Is this fair? The tickets are still in her name and as I said I've received nothing, so legally aren't they hers?

But you will receive them when she gets them herself!
I think you are being unfair to the girl. It is not her fault you can't make the gig.
When she gets the tickets you should sell them on yourself. That's my view.0 -
So, let me get this straight, you paid your friend to buy some tickets for you but have now changed your mind about going (for whatever reason)?
Who do you think should end up out of pocket in that situation?
Hint, the correct answer is 'not your friend'

I agree with above - if you'd bought them direct from the venue then you wouldn't be able to get a refund... so why should it be any different with your friend?
You agreed to buy the tickets - so they are yours.:hello:0 -
Yes, definitely you.0

I agree with the rest of the posts, the tickets are yours and your friend has no need to refund you.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. Totally agree with you. It would be the same position if OP purchased and paid for tickets off a secondary market ticket selling site, the tickets would be OPs from that point, even if not yet received in the post. I think it is unfair of OP to expect to get a refund after purchasing the tickets because she has purchased from a friend instead of another seller.0 -
I got tickets less than a week before concert dates on several occasions.. I think the last lot arrived on 28th May for 14th June.. they were really early! though I think I'd be chasing the sellers if they hadnt been dispatched 4 days before.
you could ask her to sell them on and give you the proceeds keeping a bit for her trouble.. or wait until you do get them and sell them yourself.LB moment 10/06 Debt Free date 6/6/14Hope to be debt free until the day I dieMortgage-free Wannabee (05/08/30)6/6/14 £72,454.65 (5.65% int.)08/12/2023 £33602.00 (4.81% int.)0 -
She stopped looking for a buyer when you bought them. You changing your mind should impact you and not her.Don't listen to me, I'm no expert!0

As others have said, you bought the tickets so they are yours. You can, reasonably, ask her to post the tickets directly to a third party if you manage to find someone you can sell them on to, to avoid any delay in you getting the tickets and posting them on.
It is not fair to expect your friend to take the hit because you are not longer going to the gig.All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0 -
