Advice for fighting Indigo parking! (bylaw 14 letters)

    Yes there is a difference.

    Mag's court would deal with a real bylaws fine (if the case was laid before them within six months). These are debateable to say the least.

    County Court (small claims track) is for small claims, such as if this was merely a parking charge notice under contract law. But Indigo have shot themselves in the foot by choosing to call theirs 'PENALTY charges' and citing Railway Bylaws. They can't back-pedal and say: ''wait a minute...no, we've changed our mind...we want to pursue this for six years and profit from it so we've decided it never was a 'penalty' issued under bylaws after all...''.
