Yep, correct. I was still married to the Ex when littl'un was born, Marley is our son's father, he went with me and is named on the certificate. But surely as we are NOT together she is not dragging anything. The marriage is not subsisting. The courts will see that IF she goes for s a financial settlement.
And what evidence is there that you are NOT together? You're still registered at an address you don't live in, and still paying the bills. Until you get the ball rolling with the divorce, there is no formal date.
She is spinning you a line, holding on, and the longer you are married - which you aren't even formally separated as it stands - the greater her claim.

i will take a guess that October was when they got married, so as soon as that dates ticks over they will have been married 2 years and the marriage is no longer classed as a short marriage and then shes entitled to 50% of his assets. SCORE!!!

How could she aquire the right to live their indefinitely??? It's my flat. I also have a child coming with someone else. Surely judges if they reviewed the emails would throw any claim out as it clearly confirms the marriage never really subsisted.
You are a Landlords, have you done ANY of the legally required things?
Tax?
Gas safety?
Consent to let?
