    Start divorce proceedings. Now.

    Don't understand the delay, given you are expecting a child with someone else, but the longer you leave it, the more weight your ex's claim will have.

    Reference the bills - well it's simple. Presumably you are not on the electoral roll there, so why would you pay Council Tax? Why are you paying for her electric/gas/water? Put the bills in her name and they become HER responsibility, not yours. She could choose to not pay, but it's her credit history which is trashed.

    It may also galvanise her thoughts about moving on more quickly.

    Stop fann!*ng about and get on with it.

    I am registered there. I'm living with my dad at the moment as he had a heart attack. I was told to pay All bills etc and ask her for rent only. I think to make it more concrete that I am simply helping her while she finds a place to move to. She won't sign any divorce papers until later in year when she moves out.

    I emailed her today that I will start the divorce now and she replied stating ' I have told u I will divorce you and don't want anything from you and want a clean divorce'. Her family don't know she is married to me. They didn't approve etc.

    But surely as we are NOT together she is not dragging anything. The marriage is not subsisting. The courts will see that IF she goes for s a financial settlement.

    Why are you letting her call the shots?

    I would change legal advisors and get cracking with the divorce.

    If she remains unco-operative, you could tell her that, as you are paying all the bills on the flat, you intend to move back in. That might make her hurry up with her move and get the paperwork signed.

    You seem to think that you 'broke up' in the eyes of the court the moment you said to each other that is it. It's not that simple.

    Is there a reason you haven't divorced her?

    You dont seem to be listening to anyone.
    You are still married.
    Your wife is living in the marital home.
    The longer you put off starting a divorce the more she will be entitled to.
    Stop paying the bills, start the divorce and think about your new partner and the child you are now having.
    This is going to get incredibly messy if you let it drag on.
    Please take notice of the advice you have already been given on here.

    Oh for heavens sake. Why are you letting somebody else call the shots. Grow a pair and look after number one. I'm sorry, but I find it infuriating when somebody is naiive. It only takes a small comment from a divorce lawyer and the spouse (ex-spouse) can suddenly chase the money.

    You have a child on the way, surely you do not want to be married to another woman when it's born! If anything because you'll not be able to start fresh if you have this hanging over you.

    If it was the wife who'd got pregnant by another man, it would be presumed to be a child of the marriage (rather than the other man).

    But if the genetic father went with the mother to register the birth, then his name would be put on the certificate.

    If the mother is married and the father doesn't go with her (or sign the appropriate paperwork) then she can either put her husband's name on the cert or leave the father section blank.
