As above, why would you ask for your cheque back, you paid to request copies of all the information they hold on you, they say they have sent ALL the information, you can't demand more than that.

As for the alledged CCTV images, as we suggested that was a lie, they haven't referred to them because they don't have any, remember this is a proven dodgy company.

If they were produced later they would be in serious trouble.

As SCS Law is an agent of UKPC then UKPC is liable for the actions of their agents. If their agent lied, then effectively they lied!

Complain to the ICO , the SRA and the DVLA.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

No it won't because that's illegal use of CCTV and an idle threat if ever I read one (and boy have I read some, from some idiots).

The CCTV will be owed by the landowner and use and storage of CCTV data is strictly regulated by the ICO. It is there for security and can't be passed around to an agent who wants to rip someone off months later over a PCN!

Not only that...come on, any footage (if it ever existed) will have been wiped within the week, back in the month of the PCN! It is NOT going to exist now and it is NOT able to be passed to a scumbag parking firm for other uses. UKPC have no CCTV and no access to it.

It is actually quite funny to read that threat; it's all hot air. That always makes me laugh. Idle threats make me think the writer must be desperate and can go swivel and be safely blanked.

You may well be correct that the footage has been wiped, but if it hasn't there would not be an issue with disclosing it under the DPA because the section 35 exemption for disclosures made in connection with legal proceedings would apply.

Suspect it is a matter of cost in that they would have to edit out all the non-relevant parts of the CCTV - which they would want to avoid. Cheaper to lie than edit CCTV
Should I request my bank to recall the £10 Cheque?

    No
Do I just report UKPC now to DVLA/ICO?

You raise a complaint with the ICO that you did not get a full reply to the SAR and point out that UKPC/SCS indicated there was CCTV available and that has not been provided. Ask the ICO to investigate the matter and require UKPC to provide all the information they have about you.

DVLA or SCS has nothing to do with it.

  • Hi there,
Hopefully I can get some guidance! I have since beginning of the year received 4 parking tickets which are from UKPC. They are not council parking but are privately owned. Read up online all about them and it has always said ignore as its not council and not much that they can do. They have chased and chased and sent me letter after letter. Last night I got a letter from SCS Law who are based in Canary Wharf. Letter says if I dont pay £630 they can send bailiffs/get a CCJ or contact my employer to ask them to deduct from my wages.

Can anyone give me some guidance what you think I should do? They are saying its because I am parked in a disabled bay but there are no disabled bays or floor marking's anywhere I have parked? One was at my friends house but that says I was parked in a designated permit holder space which also is not right I wasn't parked in anyone's parking space etc.

What would you advise me to do? They ask me to get in contact but refer me straight back to UKPC? They are not acting for UKPC? The letter also is a signed signature like a photo copy and paste in? Forums online say keep ignoring?

    HELP! Rosie

Rosie, you must start your own thread.

Then we can tell you all about SCS Law about their complete misunderstanding of how this works.

They or UKPC cannot do what they say until a court judge says so
