Send a Subject Access Request and ask for a copy.
What a very good idea. :T

Send a SAR to UKPC, yes, do that now and ask for all photos of your car and alleged occupants, including CCTV, ANPR, camera pictures, everything. The SAR goes to the COMPANY not their solicitor and does not need the claim number on it because this is something anyone can do:

Parking wardens employed by our client witnessed you park your vehicle at "..." without utilising the facilities of the shopping centre. 24 hour CCTV footage is in operation at the site and this will be relied upon to evidence you having left the site, in breach of the terms and conditions of parking, should this become necessary

I don't believe a word of it, no more truth in that than the statement they have "parking wardens" trying to make them sound scary and legitimate.

I have never seen UKPC with CCTV cameras on any car park, and they were all round my area like a rash as their covert HQ is near me.
It would have to state it is used on clear signage in the car park too, by law

Any CCTV would be operated by the shopping centre and you have a right to see anything they have on you if it exists by law, it could be beneficial anyway to give them the grief over what their PPC Muppets claim:

Seems like UKPC HAVE a new wheeze ?

    As coupon-mad has said
"The CCTV will be owned by the landowner and use and storage of CCTV data is strictly regulated by the ICO."

If, and supposing if ...... the landowner passed CCTV to UKPC, they would fall foul of the ICO and could be fined and more

A SAR to UKPC is the perfect answer as that is what you would rely on in court and in particular if they do NOT provide the footage which is easily converted to a MPEG file or similar to confirm their story, a judge would not accept this as evidence if it cannot be seen.

You may also like to contact the landowner asking if they provided UKPC with such footage reminding them that CCTV data is strictly regulated by the ICO

If UKPC ignore your SAR then report them to the ICO with a copy to the DVLA

Frankly, I do not believe for one moment they have CCTV footage and such scare tactics are menacing. Again a complaint to the DVLA and the BPA

I cannot thank you all enough for your prompt and informative replies. Judging by the replies, the best way forward now is to send an SAR to UKPC, with an enclosed cheque for the amount of £10.00? I saw this on the link provided by Coupon-Mad.
In the meantime, should I reply to SCS law at all? Or just leave it at the SAR to UKPC.

    Thanks again all.

    Regards,

    Regards,

As coupon-mad says, send it to UKPC, DO IT BY "proof" of post" from your PO and get a free receipt.

These cowboys may reject a recorded delivery letter

Do not underestimate the power of a SAR, THEY HAVE UP TO 40 DAYS to respond, no reply means a complaint to the ICO who takes the supply of data when requested very seriously.

If SCS law pester you further, then a simple letter from the registered keeper instructing them to cease as their client has been sent a SAR, they will know what that means.

Do let us know, we all want to see the so called CCTV clip.
Remember, no CCTV clip means no case to answer

A failure to respond with 40 days is a breach of the 1998 Data Protection Act for which damages may be sought under section 13 of the Act.
(I would also suggest that you send a copy of the SAR by email; ICO don't accept Proof of postage as proof that it has been received, but they do accept emails!)

Hey guys, thought I'd just give a quick update on what's happening regarding SCS law and my recent Subject Access Request which I sent to UKPC.

As previously recommended by several users on here - I issued a Subject Access Request to UKPC requesting everything they held on me regarding my two tickets.. All imagery of my car and the alleged, all letters and documents held, I also requested all CCTV footage - and I enclosed a cheque for £10.00.

I have recently received a reply from UKPC which says -
    "Dear Mr______

As per your recent subject access request, please find enclosed all information currently held by UK Parking Control pertaining the two parking charges above.
We trust this satisfies your request.

    Yours sincerely.. UKPC"

Now, there has been no acknowledgment of the CCTV footage which I requested - Instead they have only included all the standard copies of all previous letters/warnings sent to me along with a few poxy small photos of my car stationary parked. (JUST THOUGHT ID REMIND YOU ALL AT THIS POINT THAT MY TICKET WAS FOR ME "WALKING AWAY FROM MY CAR AND NOT USING THE OUTLET CENTRE/SHOPS".

I've checked my bank balance today and they have cashed the £10.00 cheque I had enclosed which I'm not happy about as SCS law had already given me all this junk in previous correspondence.

I now need to know where to go with this, do I reply to UKPC law and once more request the CCTV footage that SCS law kept threatening to use against me in court? Do I just report UKPC now to DVLA/ICO? What about my £10 cheque?

EDIT: Should I request my bank to recall the £10 Cheque? I feel I should let it go through as I then can say I paid for something I did not receive and would go in my favour should this decide to go any further.

    All replies are greatly appreciated.

The purpose of the SAR was to get UKPC to prove to you that they had CCTV of you leaving the car par park.
UKPC has failed to respond to the SAR in a correct manner and I think we all knew they would never provide any CCTV footage.
This was £10 very well spent

SCS Law stated a fact to you when they said
"Parking wardens employed by our client witnessed you park your vehicle at "..." without utilising the facilities of the shopping centre. 24 hour CCTV footage is in operation at the site and this will be relied upon to evidence you having left the site,"

Clearly there is no CCTV footage so either UKPC lied or SCS Law lied or both.
This is no different to UKPC taking fake pictures in an attempt to extort money.

Now is the time to start a full investigation going with the ICO, DVLA, BPA and the SRA

You have been threatened and intimidated by SCS Law saying they will use CCTV as evidence, yet their principal UKPC have failed to provide the evidence upon request
