It's also an offence for the managing agents to allow it to continue on premises they manage...i.e a leasehold flat. As long as they are doing something active to stop it from continuing they have a defence...and as long as they know about it which the OP can inform them whether or not they are a leaseholder or letting the property through a letting agent or landlord.

How bad will it be to live next door to them after the police have paid a visit? I'd imagine worse, they'd suspect you and as they cant partake in their favourite activity anymore they may start on the booze and get violent.
Although the police paying a visit will not make the slightest difference to their activities in any way- unless they are growing the stuff- are they Vietnamese? Do they have a power cable running from the lamppost to the attic?0 -
I had a neighbour like this, one night at the suggestion of my wife I went round to complain.
Turns out they were lovely friendly people and I fell out of their house 5 hours later.
The only upset was when my wife caught me making the most epic sandwich known to man, made with just about every ingredient from the fridge.0 -

My daughter lives in an ex local authority property which has several cannabis smoking neighbours who all smoke outside in their gardens. Personally I hate the smell but it doesn't bother her at all. If I lived there I wouldn't be particularly concerned about any health implications but I would be very upset that I couldn't enjoy the garden.
The way I see it you have four options:-
1) Report your neighbours and see if you can get them to stop (unlikely).
2) Sit it out until the end of your tenancy.
3) try to negotiate an early release from your contract (could be costly)
4) Do nothing and learn to live with it.0 -
The letting agent will do nothing. Ring 101 first and see if that helps. Maybe it will stop them doing it so openly. Otherwise, unfortunately you'll have to put up with it until your lease ends. You can give notice in the 5th month and move out on the very last day of the lease. At least its not a 12 month lease.
We rented a house with next door neighbours from hell for 3 years. Just had to k eep ringing the police although it made no difference. We moved out in the end, thank god!!!0 -
If they were breaking into your house and smoking in your front room, yes, you might have a second hand smoke argument.
But if they are doing it in the garden/their own home, and only trace amounts of fumes are entering your home, I refuse to believe there is a statistically significant health risk. There's just an annoying smell.0 -
we had the exact same situation a few years ago.
firstly, ring the non emergency police, they will take it seriosly. ours came round within hours with the riot van and also increased oatrols, even asked us to ring in whenever they were smoking in the garden and they would come round straight away.
i dont know the layout of your garden etc, we had a 6 ft fence put up and that did help reduce the transferof smell,as did lots of smelly plants akong the fence.
do let your letting agent know and ask them to look at blocking up the bathroom gaps. you need to protect your deposit and they may say you have been smoking and charge for cleaning and soft furnishing.0
