google an insurance term called "betterment" - if the only repair they could do would put his car in better condition than pre accident he will get a charge from them towards the cost.

You have photos of your car too?
Tell your insurance company you have the photos and they will see the preexisting damage and be able to assess whether the speed was enough to cause injury based on the minimal damage to your car.
Tell the other person to direct all further contact to your insurance; you are not liable to them (that's why you have insurance!).

Chances are he knows he won't get much for it, and has given a high random number for you to pay out of your own pocket - don't.0 -
Given this persons dishonesty I would personally be somewhat inclined to claim they hit me and then go for a whiplash claim myself, along with all 8 family members that were in my car at the time............
