    When I was a union rep I won a case where the company's dedicated car rental company had paid a private PCN and charged it to our employer's corporate credit card. I argued that the charge was neither a fine or a penalty and the rental company had denied my colleague the right to appeal. They agreed and returned the money to my colleagues' corporate card.

    OP, if you have a union rep, get them involved. Unfortunately you may have to educate them and point them to this site first.

    I had a similar situation twice with my employer. The first case was where they paid the PPC and wanted to deduct from my wages. I informed them, in no uncertain terms, that any such deduction was an unlawful deduction and if it was carried out then they would have a grievance on their hands.
    The second instance was where they wanted to again pay the PPC (to prevent the company name being tarnished). They had to be beaten into a corner to get them to discharge their PoFA liability by naming me as keeper, which then allowed me to challenge via POPLA.
    In both cases the Fleet numpty esteemed colleague insisted on referring to the clause in the Drivers Handbook about the driver being liable for fines. He didn't seem willing to understand that these are speculative invoices.
    Speak to your union representative if you have one. I bet that there have been thousands of these invoices paid all over the country and worker's wages deducted.

    Hello again, parking prankster I may need to take you up on your kind offer of assistance!

    My work have replied saying I need to contact the PPC and advise them that it is a lease/company car and by law they must let me appeal. Hmmm, even if they let me appeal I can't see them refunding me!
    I think I need to push this with work, does everyone agree?

    I have only ever read/been told that once you pay you cannot appeal. Maybe they are thinking of the local authority parking fines (not speculative invoices).

    How do you make that leap? The columns on the right in the BPA CoP have never meant anything and are not a summary of what a PPC 'can' or cannot' do or anything useful. I've never given them a second glance and just because there are more columns now doesn't mean any more than it ever did, AFAIK.

    Edna - I am pretty sure the lease company know who the driver is. They seem to know who I am when I call for service, maintenance issues. However I can see why it's easier for them to pay and charge a fee, bill the company who automatically deduct from my wages!
