the period of limitation shall not begin to run until the plaintiff has discovered the fraud, concealment or mistake (as the case may be) or could with reasonable diligence have discovered it.
On the presumption that the failure to disclose a car as being Cat D would be one of the three.
I'm not sure that flies TBH.
Where do you stop with that? Car had a new engine 6 years ago - "oh i wouldnt have bought it had i known and the dealer didnt tell me therefore thats frauds and i'm entitled to some money back"?
Its a 10 year old car. The owner has had 8 years of driving it and didnt twig nor was he told by any mechanic / MOT centre there was a problem.
I just cant see that after 8 years you can expect a dealer to stand over a car.0 -
Bit late now, but lesson learnt, it's worth getting a HPI check yourself.0

who has actually done the hpi check ? the potential new owner ? have you carried out a hpi check yourself ? [ not a ten bob text hpi check, a proper one ] maybe the potential buyer is pulling a fast one ?0

Actually I was offered acceptance of a Cat C car against a used BMW from a dealer last year.Plus the fact it was a Cat D - no BMW dealer would touch it so their 'valuation' is a bit meaningless.
Anything of this age/Cat D would be non-main dealer material and with write off being nearly 10yrs ago then condition is more likely to impact price than Cat D
I chose not to go with them though.0
