HELP: CIFAS Marker Category 6 Misuse of Facility

    Lloyds It says “there is no maximum amount” that a current account customer can withdraw in cash without notice, but that it would be dependent on ID and “collateral” presented – ie, a debit card – as well as the amount of cash held in the branch. If there is insufficient cash at the branch, the customer will need to give two days’ notice, assuming they pass the ID and verification checks. “We would add that in order to protect the customer we would promote alternative payment methods such as faster payments, Chaps or banker’s draft.”

    Its not meant to happen that way but on the rare occasions it does. This happened to me a few years ago with my Nationwide BS account.

    Thanks guys for your advice. I received a call this morning from Lloyds after sending the complaint letter yesterday. They told me that the CEO has asked an Executive Complain Manager to look into it and they will be in touch with me today regarding the outcome. They said “some of our processes regarding fraud may be automatic. We appreciate this and we will ensure that as part of the investigation we will identify these errors” I don’t know what it means but it seems to me that registering names to CIFAS might be automatic! If that is the case, then this is really bad. They will call me before 2pm today. Will keep you posted.

    To the OP, I hope it all gets sorted for you. Like you, I deposit money into a newly opened current account even before I receive my debit card/PIN. I will have to change this habit, not really worth it in order to gain an extra £1.50 in interest.

    If you haven't got an outside/shared mailbox, could you potentially have a 'dodgy' postman/woman?

    I know, I did it for the interest and it was certainly not worth it. Two of my neighbors have had trouble with post too. I think it might be the some of the youths. I see them hang around the mailbox sometimes but I can never be sure. We have a shared mail box which is located in an unsupervised area of the block of flats we live in.

    By shared do you mean your wife and you share a mail box or all the residents share a mail box.

    I just came off the call with Lloyds and they have confirmed that they will be removing the CIFAS marker and that I was placed there ‘systematically’. They apologised for the error and have offered both me and my wife £100 each for the trouble. I told them that their error led Santander to close their accounts with us too but they confirmed that they could only deal will what went on at Lloyds. I am going to write a complaint letter to Santander and I will enclose the confirmation letter from Lloyds (when I receive it) and tell them that I am unhappy with them closing both me and wife’s accounts. I am so happy that the CIFAS marker will be removed, but livid it was a mistake! This could mean that there are people out there mistakenly registered at CIFAS with no clue.

    Cards and pins are never in the same envelope, but sometimes they do end up arriving on the same day (the second gets through the post system sooner and catches the first up.) Both arrived on the same day when I opened my Halifax account.

    I am the opposite and never deposit money while awaiting a card and pin. I was thinking of changing it (as I essentially lost almost 3 weeks of interest when opening my FlexDirect in December.) In light of this, I won't.

    I don't have any advice but I hope this gets resolved soon.

    I am glad everything apart from Santander is ok now HL.

    What is worrying to read is that CIFAS flags can be placed automatically by a computer on a persons file. These things are necessary to protect businesses but they can ruin anyones financial life and should only be able to be placed by someone with authority and knowledge, when there is proof of fraud.

    As I've stated before, you should be speaking to a solicitor, not wasting time writing and complaining yourself. £100 is an insult and pretty basic level of compensation given that your other accounts elsewhere have been closed due to their mistake, especially given that Santander may not choose to re-open them - meaning loss of interest (I'm assuming with your levels of savings you had a 123 account?) due to the CIFAS warning closing your account and future losses also. Not to mention time wasted on calls, letters, going to the branch and being humiliated to withdraw your money/treated like a criminal etc. Also, the CIFAS marker was placed on BOTH your names so you should be receiving a high award. A solicitor will be able to get you much better level of compensation because this isn't just a small error.
