URGENT HELP PLEASE.threats from car dealer

hi all.
i really need some advice on this one.
hubby brought car 2 weeks ago from dealer 2nd hand.4 years old.
to cut a long story short he got it on finance and payed £1800 cash deposit.within 1st week it needed new gearbox.dealer fitted it aparantly new.
2nd week,guess what it now needs a new engine.
dealer said theyd get it done.but also mentioned about grinding off the engine numbers and other stuff that worried me.
after all the messing around we just want a refund and to end it all.
but 10 mins ago i got a call from the dealer who i must say was extremely loud,rude,threatening and abusive.
he said hes not going to fix it, and called me all the names under the sun.
i hung up .
5 mins ago he called again.threatening me yet again..calling me a C***!!,telling me to F*** Off! he said im not getting a refund and other abuse.
so what on earth do we do now.
we have spoke to the finance company and they are aware but are unsure as to what to do.
legally i know were entitled to a refund..but how on earth do we go about getting one because theres no way the dealer will co-operate.
any help would be greatly appreciated

not sure what i'd do - i'd be tempted to speak to the police though. things like grinding off engine numbers and threatening phone calls sound quite bad......:happyhear0

Call the police about the abusive calls, report him to your phone company

yeah definately get in touch with the police as grinding off numbers is a way of removing the indentity. If the police stopped you and found this then they would assume its been stolen.
Im guessing they wont help get your money back so ringing CAB may be the best idea. With all that which has gone wrong then you should be able to get your money backSmile and be happy, things can usually get worse!0 -

spent last hour making calls to various places.
spoke to the finance company who sent me elsewhere,then the british credit act,then trading standards,then back to london and surry finance and now hubby is on phone again to british credit place.
i have full knowledge of my rights as a consumer but so far their not getting me very far..will keep you updated0 -
I would have thought the local council and trading standards were the people to contact initially0

I've no experience of these recorded call providers so this post isn't an endorsement. But I'd certainly think about exploring this option, and then telephone the garage again -- get your husband to do so in pursuit of further clarification.
As other posters have said, you should be dealing with both the police and CAB.0 -
well.we took the car back to him the 2nd time about the engine.
he said itd need replacing,we then asked him what would happen with regards to the engine numbers and he said he would grind them off.i was worried about this as we didnt want legal problems after we got the car back
when we got back hubby called the finance company and said to them about what the dealer had said with regards to the engine numbers.
i then presume the finance company rung the dealer and mentioned about the engine numbers issue as it was just a matter of minutes later when we got the call from the dealer.shouting.one of the first things he said was "ARE YOU TRYING TO GET ME F****** ARRESTED YOU C***!!!" i managed to record most of the 2nd call but its hard to hear some parts as my hubbys voice overpowers the dealers,but its clear how abusive he was0 -
lol..was just saying how i recorded the 2nd call.then you posted this at same time.
i recorded it using my mobile phone voice recorder.held up to hubbys ear.

Just so you are aware of the fact, your contract (for Hire Purchase) for this car ISN'T with the dealer, but rather with the finance company, and it's them you should be pursuing. If it is a Regulated Credit Agreement, then there is joint liability between the dealer and finance company. This means that if you get no satisfaction from the dealer, you can pursue the same claim against the finance co. This is covered in The Consumer Credit Act 1974 (OFT Guidance). You can tell if it's Hire Purchase or a Regulated Credit Agreement as it will say it across the top of the first page of your copy of the agreement.
You need to contact the finance company again, and tell them that you want them to take the car and refund you. This refund would include the £1800 deposit you paid the dealer. You could alternatively offer them the opportunity to repair the car for you (free of charge!), but due to the very short time you have had the vehicle, and the fact that there has already been one major repair, I don't think they have an argument that you have 'accepted' the car, and therefore cannot make you accept a repair.
