Update: edited the appeal to include a challenge re the use of a premium number. Couldn't find any other appeals using this so had to mostly draft it myself.
Edit in red in the appeal on first page.0 -
Here's one I wrote on November which was about a firm which was using a premium rate number and was also trying to add a blanket cost for any card payment (also unlawful):

Not saying POPLA appeals are won on that point (never seen one) but it's worth including. Does the PCN in your case try to add a blanket admin fee for all card payments as well as the premium rate number?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I notice from your photos that the signs mentioning the parking charge are certainly not on every post/in every area - and nor are they lit.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Absolutely right, I will add this to the appeal.0 -
Management company informed me that they cannot get the ticket cancelled as the maximum number of tickets which they can cancel "has already been reached".
Does anyone know whether such a restriction is legal? Apparently it is in their contract0 -

Legal = Criminal law.
Lawful = Civil law.
It matters not here but should be remembered for anyone who ends up dealing with court.
Ask for an un-redacted copy of their contract showing this rubbish, sorry, clause with the number of cancellations permitted/month/year/eon. Say that your lease for the parking space trumps whatever they can produce, and that you were in any case displaying a valid permit. Show them the permit pictures. Scammers versus yours, and demand to know why they are permitting such a scam to be carried out.I married my cousin. I had to...I don't have a sister.

Thanks I will try although not very optimistic. They don't seem to give a flying !!!!... After all who cares if residents parking in their own bay have to pay £100. In fact, it benefits them as they seem get 10-20% of the moneys received from the fines!0 -
If they've had to cancel to the maximum number already, it must be an indicator that the PPC is unfairly/incorrectly issuing parking charges and the MA should either have the quota increased, or get rid of the problem entirely - sack the PPC off!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
