Excel Parking Services/DRP Bailiffs - I was parked legally and have the receipt.

    They can pursue the alleged debt by sending begging of threatening letters forever but have six years to go to court.

    So would it not be sensible to write to excel parking services even after 28 days and attach the receipt? One would think they would close the case after receipt of this..

    its worth a try , but DO NOT INDICATE who was driving

    just say the driver has allowed you to show the receipt as proof that the contract was agreed and paid for at the time

    they may fob you off to DRP or BW LEGAL, so ignore DRP but do the same if fobbed off to BW LEGAL

    Excel and VCS are from the same 'stable' owned by horsey nouveau riche ex-clamper Simon Renshaw-Smith and yep there are loads of threads about BW Legal and VCS and Excel, here's another:

    If you send a copy of the receipt make sure it's a copy! Keep the original in case they try a small claim which in your case will be very defendable. We are hearing several people saying that Excel have accused people who have paid/displayed, of not paying & displaying.

    This is a nasty pattern best exposed in court if they try. But I agree with Redx it is worth a try; email Excel using the email addy on the original PCN and at the bottom of their letters. Always include your name and postal address and VRN and PCN number when emailing Excel but (as Redx explains) write in the third person about 'the driver' and do not say who was driving.

    I have have received a letter from the lovely people at DRP threatening me with a ccj. I receive a letter months ago from parking company and ignored it as a lot of advice was to ignor. I parked my car in a car park behind boots in Southampton, I paid and clearly displayed my ticket, I didn't run over time and I saw no clear signs that I couldn't park there. They cleverly took a photo of my husbands staff pass for work parking and not the side where the receipt was displayed. They said I didn't have a valid permit. I paid to park there. I was in a space. I didn't over run on time. They didn't leave a ticket on my car at the time, I just received something through the post about a month later. That when I first knew about it! How can I have evidence? Except my husband who was there with me when we parked there? I can't appeal, and it's unfair that I got the parking invoice in the first place. I do not want a ccj on my credit report for some bloke taking the proverbial! There was signs at the back of other shops saying private parking, but I didn't park there I parked and displayed my ticket in the bit where everyone was parking......... Please help!

    Nope! Not on this thread, you need a new one of your own, otherwise advice gets confusing. Is the parking company you are dealing with Excel?

    If you're at DRP stage, you're out of time to appeal, so read the newbies FAQ sticky - post #4 - which will tell you exactly how to deal with DRP!

    Just a quick one on this.. So when I say I have the 'receipt'..


    This is a receipt from the cashless payment solution (RINGO) which indicates my parking was paid for and started 2 minutes before the alleged time of contravention.


    This has my name, address, registration and is an electronic copy which can be printed out.


    Is there anything I should scrub on this before sending it out??


    Also - the NTK has my name on it and my email will have my full name as my email address - so when you say DO NOT INDICATE who was driving (which I am happy to write in Third person) - does this not infer the person who was driving was me, as email, receipt and NTK are all on my name?

    if they had witnesses and evidence that you were driving, then its hard to refute, as would the case if the judge asked you directly

    otherwise it is supposition and not PROOF on their part as to who the driver was, unless that same person is stupid enough to admit who was driving, they have contacted the KEEPER because they have no actual proof of who was driving

    the car could have been left in the car park by a driver and yet the keeper could be the person who was an occupant of said car and who paid ringo

    these two people could have gone their separate ways from the car park in opposite directions and both might have a set of keys

    when my wife parks in a disabled spot with me at asda for example, she drives , but she does not own a BB nor does her name appear on the V5C

    so in my case I am regularly NOT the driver yet that driver could breach the parking rules (allegedly) yet I would receive the NTK

    if the driver is not admitted, then all the inferring in the world does not constitute EVIDENCE, its their task to prove their case beyong 50% probability, plus they have to have locus standii , proper signage according to the CoP etc (plus conform to consumer laws too, and conform to POFA2012 where applicable)

    I would redact any info they dont already know , like RINGO account number etc, and bank details like sort number and account number

    this is a game you are playing, of one upmanship, where you are daring them to show their hand and prove their case to the letter of the law before a judge, if they take it that far

    so NEVER hand them details or evidence and never admit who was driving, let them infer whatever they like, that you are a martian if needs be, but they must prove it too
