Excel Parking Services/DRP Bailiffs - I was parked legally and have the receipt.

    You could simply have been a passenger in the vehicle, but agreed to pay for the parking ... someone else could have been driving. ;)

    I have an update on this case..

    I suspect the advice will still be the same but will provide the update anyway.

    So it seems after I scrubbed all the info and sent a 'Debt is Denied' email and warned DRP about their actions if they take it to court, they have now moved this through the so called chain and low and behold a letter from 'Zenith Collecitons' arrived yesterday.

    Another desperate attempt to extort money and it seems they will now accept a discounted payment in a desperate attempt to get me to try and get me to part with my money for a breach which did not even occur!

    Here is what I know:

    1) Zenith is a subsidiary arm of DRP Ltd - bunch of cow boys.
    2) The debt is still unenforceable
    3) I can carry on ignoring until it goes to the next chain.

    Question:

    Is it worth writing another email this time to Zenith denying the debt and providing the same proof as was given to DRP with the scrubbed info?

    Or simply send an email stating the debt is denied and do your worst!

    If I remember correctly, Zenith are in the same offices as DRP - just a different desk, probably occupied by a different person, so you should be able to treat them as you did DRP :)

    If you look at the bottom of the letter I believe it says Zenith is owned by Debt Recovery Plus why waste your energy?

    Neither. Ignore the debt collectors means exactly that.

    READ THIS BEFORE YOU WORRY ABOUT OR POST ABOUT DEBT RECOVERY PLUS OR ZENITH!

    Not to say that Excel might not try a small claim, because sometimes they do, via BW Legal at the moment, who you would need to respond to if that occurred. But replying to debt collectors is pointless.

    You could search the forum for 'BW Legal Excel' to see what can happen and what to take seriously/how to respond if you get that letter.

    Final suggestion - have you actually emailed EXCEL with this evidence, if not, email them and tell them you are being unfairly harassed about this PCN and the 'debt collector' has ignored you. So you have decided to set out the position in this email to Excel to avoid the matter proceeding further when they have no prospects of success in any small claim, under the circs:

    Tell them this:
    Anyway, I was pretty positive I had paid for it by a cashless solution so I checked and lo and behold I had paid for parking 2 minutes before the alleged contravention time via the smartphone app and I have the parking receipt to prove it.

    and tell them this to explain why no appeal was made at the time:
    I should also state that I did not receive a 'parking charge notice' as stated in the NTK - as 'A PCN was either affixed to the vehicle or issued through the post but remains unpaid'.
    I was away abroad for a few months due to a family bereavement

    I would do this because:

    a) Excel might actually cancel this one based upon what you have said here, you DID pay.

    b) it looks more reasonable on your part if you've shown your hand now to Excel and explained that they are mistaken. Better than having to defend in court and explain to the Judge why you didn't tell Excel this earlier.

    Sorry - a couple of corrections -I actually emailed Excel not DRP - that was an error on my part. I informed them that parking had been started 2 minutes prior to alleged contravention time and provided the scrubbed out proof.

    I also said that the matter is considered closed and no further communication will be entered into with Excel or any of their representatives.

    I am still awaiting a response.
