So it's a DEA, which the employer must notify your husband about, in writing.

The DWP notify the employer to take an amount from wages, the employer does not have to notify the employee at all.

In fact the employee should also receive a copy of the DEA which is normally sent to their home address should they have it on record.

My comment was in answer to your post stating the employer has to notify the employee of a DEA.
Yes of course they have to tell the employee what amount has been taken and how it was arrived at, what I meant was the employer does not have to tell the employee before taking the money out, as your post above states the information of what was taken and how it was calculated can be put on the employees payslip.

And as the OP stated they did receive a DEA copy letter from the DWP probably before the DEA was implemented.

    Update:

Our MP has now contacted the DWP and asked them to provide a report of what and how this happened. We have also been given the "District Manager" details and they have been contacted too.

Another strange thing is that we have already spoken to a local fraud investigator within DWP, in 2005. She never logged it as fraud. We always thought the contact name we had was actually a Police officer. Turn's out she was the fraud investigator!!

    I will post the outcome!!

Congratulations on getting the monies refunded. You can certainly try to take it further but I doubt you will actually get very far. I can almost hear "It was so long ago we no longer have any record of what was reported" being given as the answer / excuse.

there must be a court order for wage deductions like this. So that would be the next step

The DWP can make an Attachment of Earnings without a court order now. I think this also applies to HMRC

ETA: That'll teach me to read a whole thread before posting!! This had already been mentioned.

    Glad you got it sorted

I know I probably wont get very far, it's just frustrating that they allowed the fraud continue when we had already reported it. Also so many lies told throughout the last 10 weeks, something really need's to be done. I know it sounds pathetic but I would like to take it to the papers or some media, to expose the complete lack of regard and total negligence.

I know the beast is bigger than me, but I would like to take the fight on...Lol

    :rotfl:

I said near the beginning that your case sounded genuine unlike the others.

I think if you did go to the media about it there'd be the usual "we can't comment on individual cases" and not much else. And other people with unbelievable scenarios - for the reasons I stated previously here and other threads - being even more "convinced" about their unlikely case.

Probably just best to let it go now without it taking over your life and just bask in the glow of success. :j

    Congrats anyway. :T
