Which appeal to use?

I have a charge from Humberside Airport and the parking company use IAS for appeals. They refused my appeal direct to themselves.
I've read the FAQ which seems to state don't bother with an IAS appeal.
So where do I appeal.

    Sixth Anniversary Combo Breaker
    Initial appeal was with parking contractor - Vehicle Control Services who rejected it on the grounds that I stopped where there were "No Stopping" restrictions. This was in a lay-by used as a bus stop which they claim "could have caused obstruction to other drivers"
    My grounds for appeal were, "I stopped for a total of 9 seconds as shown by the photographic evidence sent with your invoice"

    ok , they have not refused your appeal


    they have rejected your appeal


    I would suggest doing some reading on the airport , as it could and probably is covered under bylaws and or the road traffic act .




    very very unlikely to go to court , they would not loke a judge to see this

    Sorry to appear a bit dim, but I'm not sure what I should be looking for with regard to the airport, bylaws, etc. and what my next steps would be.

    actually that's what they want you to be , dim and pay up .


    just type JLA (john lennon airport) or Humberside Airport into the search box , you will find thousands of cases.


    what they are doing is 99% illegal


    1: stopping is not parking
    2: the land is non applicable for private parking


    your details given by the dvla on proviso it was for a parking offence on relevant land


    VCS or other companies working airports/railway stations are frightened to bring cases to court and there sordid system to be overheard by the public at large , in fact they are happy that 50% just pay up!

    here is some light reading for you ........


    The scammers that infest some of the smaller airports are in cahoots with said airports as its is a (allegedly) mutual financial arrangement ....

    Go back several years and you would have won this at a POPLA appeal ..... however in the world of PPC's they created another trade body (the IPC) that have a (again allegedly) kangaroo court :eek: (the IAS) The IAS seem to treat appeals as a lottery 80%+ loose irrespective of the evidence.......

    you therefore can, after reading the below, do the first appeal (a new template for the IPC is available) ,and then ignore .... or do the appeals as a paper trail.









    a while ago VCS did try out a small claims court case over such ....and as predict that they pulled out before the trial ..... . They did not dare try placing this before a real judge! and have not yet tried again ..... I wonder why ?

    Why do people ALWAYS want a 'next step'?! There is no next step or the threads would say so. Relax.

    Nowhere. If there was a next step the FAQ would tell you, but instead it tells you clearly to just sit tight and ignore the debt collector drivel.

    I appealed via IAS on the basis of genuine loss using the info on here and as expected it failed.
    This is the adjudication.

    "The Appellant should understand that the Adjudicator is not in a position to give him legal advice but he is entitled to seek his own independent legal advice if he so wishes. The Adjudicator's role is to consider whether or not the parking charge has a basis in law and was properly issued in the circumstances of each individual case. In all Appeals the Adjudicator is bound by the law of contract and is only able to consider legal challenges and not factual mistakes nor extenuating circumstances. Once liability is established only the Parking Operator is able to vary or cancel the parking charge based on mitigating circumstances.
    In this case the photographs of the incident show 3 breaches of the terms and conditions that are extensively positioned around the Airport in clear and obvious signage and consistent with many other Airports in the country in the times in which we live. The first is that the driver stopped to pick up a passenger when the signage made it clear where pick-ups were permitted and were not permitted. The second is that the car stopped on double yellow lines and the third that the car stopped in a bus stop which is not for the use of private cars. In relation to each of those breaches this Appeal must fail. The Appellant raises a number of issues which have little or no relevance to those three points and he is entitled to take up his issues in a Court if he so wishes as this decision is not binding on him. I am satisfied that the P.O has the authority to act on parking issues having seen their contract with the landowners. I am satisfied that the signage has been independently audited and approved by the I.P.C and complies with Industry norms and fully brings to motorist's attention the terms that apply to not stopping in this area for any reason.The recent case of Parking Eye v Beavis deals with a number of the points that the Appellant raises and were decided against him by the Supreme Court. In particular they decided that the P.O's charges were justified in view of their overheads and in view of charges in the non-private sector."

    The IAS appeal decision changes nothing. You now ignore anything and everything you get for six years unless it is real court papers. If that happens than you read up on how to beat the scammers in court.

    Why are you telling us you ignored our advice? Now you feel despondent, like you have no case, don't you, which is EXACTLY why the NEWBIES thread tells you not to do this.

    You would have felt better to have just sat tight and ignored letters than to feel you have 'lost'. It was a kangaroo court, why did you try this?
